1. No Smoking
Smoking is strictly prohibited inside the residence and in all enclosed areas of the property.
This prohibition includes cigarettes, cigars, pipes, vaping/e-cigarettes, cannabis, and other smoked or vaporized substances.
The Tenant shall be responsible for any damage, cleaning, deodorizing, or remediation costs resulting from smoking in violation of this provision, to the extent permitted by California law.
2. HOA Rules and CC&Rs
The Property is subject to the rules, regulations, Covenants, Conditions & Restrictions (CC&Rs), and other governing documents of the applicable homeowners association.
The Landlord will pay the applicable HOA assessments and fees associated with ownership of the Property.
The Tenant agrees to:
* Comply with all applicable HOA CC&Rs, rules, regulations, and reasonable amendments.
* Ensure that all occupants, guests, and invitees comply with the HOA requirements.
* Not engage in conduct that results in fines, penalties, violations, or other charges against the Property or Landlord due to the Tenant's actions or the actions of the Tenant's occupants or guests.
To the extent permitted by law and the governing HOA documents, the Tenant shall be responsible for fines or charges assessed against the Landlord or Property as a result of the Tenant's violation of HOA rules.
3. Utilities
Unless otherwise stated in the lease, the Tenant is responsible for establishing and maintaining utility service in the Tenant's name and paying all charges associated with the Tenant's use of the Property, including:
* Electricity
* Water
* Waste/trash service
* Other tenant-responsible utilities specifically identified in the lease
The Tenant is responsible for utility charges beginning on the commencement date of the tenancy and continuing through the end of the tenancy, subject to applicable law and the terms of the lease.
Solar Electricity
The Property is equipped with a solar energy system.
Solar production does not mean that the Tenant's electricity usage is provided at no cost. The Tenant remains responsible for applicable electricity charges associated with the Tenant's consumption, including any charges, fees, or amounts not offset by solar production, as provided in the lease and consistent with the applicable utility billing arrangement.
The lease should identify the exact method by which electricity charges will be determined and billed to the Tenant.
4. Renter's Insurance
Tenant shall obtain and maintain renter's insurance throughout the entire tenancy.
The policy should provide personal property coverage and liability coverage of not less than $100,000 per occurrence, or such other minimum amount stated in the executed lease.
Tenant shall provide evidence of active renter's insurance upon request by Landlord and whenever reasonably required under the lease.
Tenant understands that Landlord's insurance does not cover Tenant's personal belongings, furniture, vehicles, or other personal property.
Failure to maintain required insurance shall constitute a violation of the lease, subject to applicable California law.
5. Maintenance and Damage
Tenant shall maintain the Property in a clean, sanitary, and reasonable condition and shall promptly notify Landlord of leaks, water intrusion, plumbing problems, electrical issues, appliance failures, or other conditions requiring repair.
Tenant shall be responsible, to the extent permitted by law, for damage caused by Tenant, occupants, guests, pets, or invitees beyond ordinary wear and tear.
Tenant shall not make alterations, install fixtures, paint, mount equipment, or make other material modifications to the Property without Landlord's prior written consent.
6. Appliances and Included Items
The Property is provided with a washer and dryer.
Tenant shall use all appliances and fixtures in a reasonable manner and promptly notify Landlord of any malfunction or required repair.
7. Pets
No pet may be kept at the Property without the Landlord's prior written approval, except where otherwise required by applicable law.
Any approved pet shall be subject to the applicable pet rules and any lawful charges or deposits permitted under California law.
Assistance animals are not considered pets for purposes of applicable fair-housing requirements.
8. Parking and Common Areas
Tenant and Tenant's guests shall comply with all applicable HOA parking rules, restrictions, and regulations.
Common areas, clubhouse facilities, walking trails, recreational facilities, and other amenities shall be used in accordance with applicable HOA rules. Landlord does not guarantee continued availability or specific hours of operation of HOA amenities.
9. Compliance With Law
Tenant agrees to comply with all applicable federal, state, county, municipal, and HOA rules and regulations applicable to the occupancy and use of the Property.
