The property will be managed directly by the Landlord. Tenant agrees to communicate maintenance requests, repairs, and property-related matters directly with the Landlord unless otherwise notified in writing.
**2. Landscaping and Jacuzzi Maintenance**
Landlord will provide and pay for routine gardening/landscaping services and professional Jacuzzi/spa maintenance. Tenant agrees to allow reasonable access for service providers to perform maintenance as scheduled.
**3. Nearby Waste Management Facility and Noise Acknowledgment**
Tenant acknowledges that a waste management facility is located behind the property. Waste management trucks may operate in the area and may produce periodic beeping sounds associated with vehicle safety systems and normal operational activity. These sounds may occur during operating hours and are outside the control of the Landlord. Landlord discloses that there are no known odor issues associated with the facility. By signing this lease, Tenant acknowledges awareness of the nearby facility and agrees that normal operational sounds shall not constitute a nuisance or grounds for rent reduction, lease termination, or claims against the Landlord.
**4. HOA Community Amenities**
The property includes access to community amenities provided by the Homeowners Association (HOA), which include:
Community pool
Community Jacuzzi/spa
Community barbecue areas
Tenant agrees to follow all HOA rules, policies, operating hours, and regulations related to these amenities.
**5. Association Pool Keys**
Tenant will be provided with two (2) keys for access to the association pool and community amenities. Tenant is responsible for safeguarding the keys. Lost, damaged, or unreturned keys may result in replacement fees as determined by the HOA or Landlord.
**6. Outdoor Furniture and Patio Amenities**
The property includes the following outdoor furnishings and amenities for Tenant's use during the lease term:
Built-in barbecue with barstools
Outdoor canopy
Patio dining table and chairs
Additional patio chairs
Tenant agrees to maintain these items in good condition and return them in substantially the same condition at the end of the lease, normal wear and tear excepted.
**7. HOA Rules and Violation Responsibility**
Tenant agrees to comply with all HOA rules, regulations, and governing documents. Tenant shall be responsible for any HOA violations, fines, penalties, or fees caused by Tenant, occupants, or guests during the lease term. Any such fines issued by the HOA will be the financial responsibility of the Tenant and must be reimbursed to the Landlord upon notice.
**8. Street Parking and Guest Permits**
If Tenant or Tenant's guests park vehicles on the street for longer than twenty-four (24) consecutive hours, Tenant must obtain the required parking permit or authorization through the HOA as required by community rules. Tenant is responsible for ensuring all guests follow HOA parking regulations. Any fines, towing, or penalties resulting from failure to obtain required permits will be the responsibility of the Tenant.
**9. Utilities Responsibility**
Tenant shall be responsible for payment of all utilities serving the property during the lease term, including but not limited to electricity, gas, water, internet, cable, and trash/waste collection services, unless otherwise agreed to in writing.
**10. Spa / Jacuzzi Use and Liability Waiver**
The property includes a Jacuzzi/spa which is provided for Tenant use as a convenience. Tenant agrees to use the spa responsibly and in accordance with all safety guidelines. Tenant acknowledges that use of the spa is at Tenant's own risk. Landlord shall not be liable for any injuries, accidents, or damages resulting from the use or misuse of the spa by Tenant, occupants, or guests. Tenant agrees to supervise all guests and minors using the spa and assumes responsibility for their safety.
**11. Tenant Responsibility for Negligent Damage and Maintenance Issues**
Tenant shall be responsible for the cost of repairs caused by negligence, misuse, or damage by Tenant, occupants, or guests. Examples include but are not limited to:
Toilets or plumbing clogged due to improper use
Broken drawers, cabinets, or fixtures
Broken tiles, flooring damage, or chipped surfaces
Damage to door handles, closet hangers, shelving, or hardware
Damage to appliances or built-in fixtures
Damage caused by improper disposal of items in sinks, toilets, or drains
Any repair costs resulting from tenant negligence will be the financial responsibility of the Tenant and may be charged to the Tenant or deducted from the security deposit if applicable.
**12. Minor Repair Responsibility**
Tenant shall be responsible for minor repairs and maintenance items costing up to
150 $200 per occurrence
including but not limited to light bulb replacement, minor drain clogs, loose handles, basic maintenance items, and similar small repairs. Any repair exceeding this amount that is not caused by tenant negligence shall be the responsibility of the Landlord.
**13. General Condition of Amenities**
All amenities and furnishings are provided for Tenant use as a convenience. Tenant agrees to use these items responsibly and notify Landlord if maintenance or repair is required.
By signing the lease agreement, Tenant acknowledges receipt of and agreement to these terms.
