1. Tenant acknowledges that the premises are susceptible to dampness if not properly heated and ventilated, which can result in health hazards and property damage. To mitigate these risks, the Tenant agrees to the following:
2. Use of Primary Heating System: The Tenant shall use the permanent, gas-fueled heating system provided in the unit as the primary source of heat. The heating system must be operated to maintain a consistent, low background temperature (e.g., a minimum of 70 degrees Fahrenheit as required by California law, or a mutually agreed-upon consistent temperature) during cold or damp periods to keep all surfaces warm and above the 'dew point'.
3. Prohibited Heating Methods: The use of portable heaters, kerosene heaters, or propane heaters as a heating source is strictly prohibited due to fire risk and potential for increased condensation.
4. Ventilation: The Tenant shall ensure proper ventilation by periodically airing out the unit to allow circulation of fresh air and reduce humidity levels.
5. Reporting: The Tenant must immediately report any leaks, water intrusion, signs of dampness, or non-functioning heating equipment to the Landlord in writing.
6. Failure to comply with these property maintenance requirements, resulting in damage to the premises, may be considered a breach of the lease agreement."
