SAMPLE RENTAL AGREEMENT
1. Premises
Property Owner agrees to rent to Tenant one (1) bedroom within a two-bedroom basement apartment located at the above address. Tenant will have shared access to all common areas within the basement unit.
2. Term This lease is for a term of ________ (TBD)
Tenant will inform Property Owner in writing a minimum of 30 days before term ends to inform of lease renewal or cessation. If Tenant does not give Property Owner 30 days' notice regarding intent to renew, it will be assumed that the lease will expire on the date above.
3. Rent
Monthly Rent: $700.00 Monthly Utilities Fee: $100.00 Total Monthly Payment: $800.00 Rent is due on or before the 1st of each month via Zelle to XXXXXX. A one-week grace period is granted. If rent is not received by the 7th of the month, a $75 late fee will apply.
4. Security Deposit
A security deposit equal to one month's rent ($700.00) plus a non-refundable cleaning fee of $150.00 (total: $850.00 per tenant) is required at the time of signing this lease via Zelle as described above. This deposit will be held by Property Owner and returned within 30 days of lease termination, minus any deductions for damages beyond normal wear and tear.
5. Parking
Parking in the driveway is not permitted. Street parking only is allowed. There is ample street parking available in the neighborhood. Tenant agrees not to block the driveway or any access areas.
6. Utilities
Utilities (gas, electric, water, internet, etc.) are included in the $100 utilities fee per month. Tenant agrees to use utilities in a reasonable and conscientious manner.
7. Use of Premises
Tenant shall use the premises exclusively for residential purposes and shall not operate any business from the property without written permission from the Landlord. No smoking or vaping is allowed on the property (inside or outside).
8. Right of Entry/Inspection Clause
Property Owner retains the right to enter the premises twice annually for routine inspections, with at least one week's written notice provided. In case of emergency (e.g., suspected water leak, fi re, or health hazard), Property Owner may enter without notice.
9. Maintenance and Repairs
Tenant agrees to keep the premises clean and in good condition. Tenant shall notify Property Owner of any needed repairs promptly. Tenant shall not make any alterations or improvements without written consent.
10. Guest Policy
Occasional overnight guests are allowed with prior communication to Property Owner. Guests may not stay for more than 3 consecutive nights or more than 6 nights per month without written approval from Property Owner. Tenant is responsible for the behavior of their guests and any damage caused by them. Guests are expected to comply with all house rules and quiet hours.
11. Subleasing
Subleasing is not permitted under any circumstances. Tenant may not rent, assign, or transfer their interest in the premises to any other party without Property Owner's prior written consent. Violation of this clause may result in immediate termination of the lease.
12. Quiet Hours Tenant agrees to observe quiet hours from 10:00 PM to 7:00 AM, in accordance with Provo City Ordinance. During this time, excessive noise, loud music, and disruptive activities are prohibited. Tenant is expected to be considerate of neighbors and other occupants of the property.
13. Owner's Right to Terminate for Unreasonable Conduct Because the Premises is part of a shared residential property in which Property Owner resides, Tenant agrees to maintain a standard of behavior that is respectful, non-disruptive, and appropriate for a shared living environment. Property Owner reserves the right to terminate this Lease with thirty (30) days' written notice if Tenant, their guests, or invitees engage in behavior that Property Owner reasonably deems to be unruly, disrespectful, disruptive, unsafe, or otherwise incompatible with the quiet enjoyment and safety of the property. This includes, but is not limited to, excessive noise, hostile or aggressive conduct, repeated disregard of house rules or shared space boundaries, or any behavior that materially interferes with Property Owner's peaceful enjoyment of the property. Property Owner's discretion shall be exercised in good faith, and such termination shall not violate any applicable housing or anti-discrimination laws.
14. Termination
Tenant must vacate the premises by the lease end date unless a written renewal has been signed. Failure to do so may result in legal action and withholding of the security deposit. 15. Governing Law This Agreement shall be governed by and construed in accordance with the laws of the State of Utah.
