Lease Terms

1. Security Deposit
A security deposit equal to 1.5 times the monthly rent will be required. This deposit will be held to cover any unpaid rent, damages beyond normal wear and tear, and other agreed-upon expenses. The tenant cannot use the security deposit as payment for the last month's rent.

2. Renter's Insurance
The tenant is required to obtain and maintain renter's insurance throughout the duration of the lease. The policy must provide coverage for the tenant's personal belongings and include liability coverage. Proof of insurance must be provided to the landlord prior to move-in and upon request. The landlord shall not be liable for any loss or damage to the tenant's personal property, and the tenant agrees to indemnify and hold the landlord harmless from any liability arising from the tenant's actions or negligence.

3. Non-Refundable Deposits

- Pet Fee
A non-refundable pet fee of $500 per pet is required. This fee covers potential damages caused by the pet. A maximum of two small pets (dogs or cats) are allowed.
- Administrative/Lease Processing Fee
A non-refundable administrative fee of $200 is charged to cover the costs associated with lease preparation and processing.
- Key or Lock Replacement Fee
A non-refundable fee of $100 will be charged for key replacement or lock changes at the beginning of the lease to ensure security between tenants.

4. Utilities
The renter is responsible for all utility costs, including electricity, water, gas, and internet. Solar panels are installed on the property and may help reduce electricity costs, but the exact savings will depend on the renter's usage. The owner makes no guarantees regarding the electric bill, and the renter should expect to pay for electricity as needed.

5. Smoking
No smoking is allowed inside of the property.

6. Parking
The property includes a two-car garage, with space for two additional vehicles in the driveway. There is also one parking spot available on the street directly in front of the house. Parking in other areas of the community is restricted by HOA rules.

7. HOA

8. Landscaping and Roof Maintenance

9. Rent Due Date
Rent is due on the 1st of each month. A grace period of 5 days will be provided, during which rent may be paid without penalty.

10. Late Fees
If rent is not received by the 5th of the month, a late fee of 5% of the monthly rent amount will be charged. This fee is in addition to the rent amount due.

11. Eviction Notice
If rent is not paid within 5 days after the due date, the landlord may begin eviction proceedings in accordance with Arizona law.

12. Use of Premises
The property is to be used solely as a private residence. No commercial activities or businesses, including home-based businesses, are allowed on the premises without the express written consent of the landlord.

13. Occupancy
The property is limited to residential use, with a maximum occupancy of two persons per bedroom. Exceptions may be made for infants or newborns, and any additional occupants must be approved by the landlord in writing. Unauthorized occupants may result in termination of the lease.

14. Maintenance and Repair Responsibilities

- Landlord's Responsibilities
The landlord will maintain the property in a habitable condition, including making all necessary repairs to essential services such as plumbing, heating, and electrical systems.
- Tenant's Responsibilities
The tenant is responsible for routine maintenance, such as replacing light bulbs, unclogging drains, and keeping the property clean. The tenant must promptly report any maintenance issues or damages to the landlord. Failure to do so may result in the tenant being held liable for any additional damage caused by the delay in reporting.
- Repair Reporting
The tenant must report any necessary repairs within 10 days of noticing the issue, or within 5 days if the issue affects health or safety. The landlord will address the issue within a reasonable time frame, as required by Arizona law.

15. Right to Entry
The landlord reserves the right to enter the property for inspections, maintenance, repairs, or showings with a minimum of two days' notice, except in emergencies where immediate access is required. Entry will be during reasonable hours to minimize disruption to the tenant. If the tenant has submitted a maintenance request, this constitutes permission for the landlord to enter without additional notice.

16. Subletting
Subletting of the property is strictly prohibited without the prior written consent of the landlord. Any unauthorized subletting may result in termination of the lease agreement.

17. Early Termination
If the tenant wishes to terminate this lease agreement early, they must provide written notice of at least 60 days and pay an early termination fee equivalent to two months' rent. The landlord reserves the right to terminate the lease early with appropriate notice as stipulated in the lease agreement. The tenant remains responsible for rent until a new tenant is found or the lease term ends, whichever occurs first.

18. Surrender of Premises
At the end of the lease term, the tenant is required to return the property in a clean and orderly condition, comparable to its state at the beginning of the lease, excluding normal wear and tear. All personal belongings must be removed from the premises. The tenant is responsible for cleaning the property, including all appliances, floors, and fixtures, and making any necessary minor repairs. Any belongings left behind will be handled according to Arizona law regarding abandoned property. The landlord will conduct a move-out inspection to assess the condition of the property before the return of the security deposit.

19. Dispute Resolution
In the event of a dispute arising from or relating to this lease agreement, the parties agree first to try in good faith to resolve the dispute through mediation before resorting to arbitration or litigation. If mediation does not result in a resolution, the dispute shall be resolved through binding arbitration, conducted in accordance with the rules of the American Arbitration Association (AAA) with the decision of the arbitrator(s) being final and enforceable in any court of competent jurisdiction. The costs of mediation and arbitration shall be shared equally by both parties unless otherwise decided by the arbitrator.

20. Compliance with Local, State, and Federal Laws
This lease agreement is governed by and shall be construed in accordance with all applicable local, state, and federal laws, including but not limited to the Arizona Residential Landlord and Tenant Act. The landlord and tenant agree to comply with all relevant laws, including those related to fair housing, tenant privacy, and eviction procedures. Any provision of this lease that is found to be in violation of such laws shall be deemed null and void, but all other provisions of the lease shall remain in full force and effect.
