HOW TO APPLY

This unit uses a TWO-STEP screening process. Applications are processed in the order received on a first-come, first-qualified basis, in accordance with California's sequential screening requirements (AB 2493)

IMPORTANT: BOTH Step 1 AND Step 2 must be fully completed and passed to be approved for tenancy. Passing Step 1 does not guarantee approval it only advances the applicant to Step 2. Final approval is granted only after all Step 2 Rentspree verifications are successfully completed and all criteria are met. Failure to pass any single requirement in either step will result in disqualification.

Step 1 : Zillow Application + Document Submission (at your cost)
Submit a complete Zillow rental application. Once submitted, you will be messaged requesting your documents (see BEFORE YOU APPLY above). Applications will be reviewed in the order received. The first applicant who meets the credit score threshold, income requirement, AND submits all required documents within 24 hours will advance to Step 2.

Step 2: Rentspree Full Verification for every adult (at landlord's cost)
The first qualifying applicant will be invited to complete a full Rentspree verification package. Landlord pays all Rentspree fees no cost to the applicant. Final approval requires ALL of the following to be passed:
Rentspree ResidentScore greater than 710
Income verified via Rentspree bank verification (minimum $13,500/month confirmed)
Satisfactory rental history eviction check via Rentspree
Satisfactory criminal background check via Rentspree

WRITTEN SCREENING CRITERIA

These criteria are applied consistently and equally to all applicants. ALL criteria in both Step 1 and Step 2 must be met for an applicant to be approved. Meeting Step 1 criteria alone is not sufficient for approval.

STEP 1 CRITERIA (via Zillow)

STEP 1 CREDIT SCORE (via Zillow)
Minimum credit score of 710 (FICO or equivalent) as reported through Zillow's screening. Applicants with a score below 710 will not advance to Step 2.

STEP 1 GROSS MONTHLY INCOME (self-reported on Zillow application)
Minimum gross monthly income of $13,500 (3x the monthly rent of $4,500) must be self-reported on the Zillow application. This figure will be cross-checked against submitted pay stubs and W-2s, and verified at Step 2 via Rentspree bank data. Applicants who do not meet this threshold will not advance to Step 2.

Note: Applicants will not be disqualified based solely on the SOURCE of their income. Only the AMOUNT and VERIFIABILITY of income will be evaluated, in compliance with California law (Government Code 12955).

STEP 2 CRITERIA (via Rentspree)

Minimum Rentspree ResidentScore of 710 for all adults required for final approval . ResidentScore is a rental-specific score generated by Rentspree and powered by TransUnion. It is distinct from a standard FICO credit score. Applicants whose ResidentScore falls below 710 will not be approved, even if they passed Step 1.

STEP 2 INCOME VERIFICATION (via Rentspree bank verification)
Income will be verified exclusively through Rentspree's bank-based income verification, powered by Finicity (a Mastercard company). Applicants will securely connect their bank account through a one-time encrypted connection, generating a verified report of deposit history from the past 12-24 months. This confirms that actual bank deposits support the gross monthly income of $13,500 or more. All fees for this verification are covered by the landlord.

STEP 2 RENTAL HISTORY (via Rentspree eviction check)
Eviction history will be checked through Rentspree. No prior evictions on record. Prior eviction filings that were dismissed or resolved in the applicant's favor will be evaluated individually.

STEP 2 CRIMINAL BACKGROUND (via Rentspree background check)
Criminal history will be checked through Rentspree and reviewed on a case-by-case, individualized basis in compliance with California Fair Employment and Housing Act (FEHA) guidelines and HUD guidance. Factors considered include:
The nature and severity of any offense
Time elapsed since the offense
Evidence of rehabilitation
Relevance to tenancy safety

Arrests without conviction, expunged or sealed records, and juvenile records will NOT be considered. A criminal history alone does not automatically disqualify an applicant.



LEASE TERM & NOTICE POLICY

This is a fixed 12-month lease. The tenancy ends automatically on the lease end date unless both parties agree in writing to renew. No additional notice is required from either party to end the tenancy at the conclusion of the fixed term.

If the tenancy converts to month-to-month after the fixed term, either party may terminate with written notice per California Civil Code 1946.1:
30 days' written notice if the tenant has occupied the unit for less than one year
60 days' written notice if the tenant has occupied the unit for one year or more

This property is a privately owned condominium and is NOT subject to the City of Milpitas Rent Review Ordinance (RRO), per the RRO's exemption for condominiums not owned by a corporation. Written notice of this exemption will be provided to the tenant at lease signing.


STATE LAW EXEMPTION DISCLOSURE

This property is not subject to the rent limits imposed by Section 1947.12 of the California Civil Code and is not subject to the just cause requirements of Section 1946.2 of the California Civil Code.


PORTABLE TENANT SCREENING REPORTS

Applicants may submit a valid Portable Tenant Screening Report (PTSR) less than 30 days old, per California AB 2559. If a valid PTSR is submitted, no separate Zillow screening fee will be charged. Note that Step 2 Rentspree verification including ResidentScore, income verification, eviction check, and criminal background check is still required for final approval, as these are generated exclusively through Rentspree.
