1. Lease Duration: This lease shall be for a term of one year, commencing on 06/01/2024 and month to month thereafter, with the option to sign another one year lease. Tenants agree to move out if the Landlord decides to sell the property or use the property for personal use at any point after the one-year lease expires. A minimum advance notice of 30 days will be given to the Tenants if such situation arises.
2. Rent Amount: Tenants shall pay the Landlord in monthly payments of $2,500 on the first of each month for the month ahead. Payment by direct deposit is preferred to avoid late payment and penalties. If payment is not received by the 4th day of the month, a $25/day penalty will be assessed until payment is made and received in full, which is why an automatic electronic payment is the best payment method. After 30 days of non-payment an eviction notice will be filed and delivered.
3. Security deposit: Tenants shall pay a security deposit of $2,000 which will be used to pay for damages incurred by the Tenants (damaged walls, ceilings, floors, fixtures, appliances, water damage, etc.) that are not fixed on move-out. Whenever there is any sort of damage, the Tenant must notify the Landlord within 48 hours to make sure the damage does not get worse. Interest of 0.1% will be paid per annum on the deposit. Tenants agree to return the property in the same condition during first move in and will perform a walk through checklist of the house with landlord upon start and end of the lease.
4. Late Payment Fees: A late fee of $25/day will be incurred if rent is not received by the due date specified in the lease agreement until payment is received in full.
5. Maintenance Responsibilities: The landlord shall be responsible for all structural repairs to the property. Tenant shall be responsible for all non-structural repairs and maintenance. Maintain the cleanliness and sanitation of the interior of the house. Keep the yard, garden, and outdoor areas clean and well-maintained. Promptly report any damages or necessary repairs to the landlord. Dispose of trash and recycling properly according to local ordinances. Use the property for residential purposes only and avoid causing disturbances to neighbors. Obtain renter's insurance. Allow reasonable access to the landlord for inspections, repairs, or emergencies. Inform the landlord in advance of any extended absences from the property. Comply with all applicable laws and regulations related to occupancy and use of the property. Return the property in the same condition as it was received, barring normal wear and tear, upon move-out.
6. Renewal Options: The tenant shall have the option to renew this lease for an additional term of 12 months, subject to mutual agreement between both parties and provided that written notice of intent to renew is given to the landlord at least 60 days prior to the expiration of the current lease term.
7. Move-Out: The tenant agrees to provide written notice to the landlord at least 60 days prior to the intended date of move-out. The notice shall include the date of intended move-out and the tenant's forwarding address for the return of any security deposit and correspondence.
8. Lease Termination: The tenant may terminate this lease agreement upon providing written notice to the other party at least 30 days prior to the intended termination date. Termination shall be subject to compliance with all other terms and conditions outlined in this agreement. The landlord can terminate or change the terms (including rent increases) with 60 days notice.
9. Property Use Restrictions: The tenant agrees to use the leased premises solely for residential purposes and shall not engage in any illegal activities on the property. The tenant shall not sublet the premises or allow any unauthorized occupants to reside in the property without the landlord's prior written consent. Additionally, avoid making alterations or modifications to the property without the landlord's permission.
10. Utilities Responsibility: The tenant shall be responsible for payment of all utilities and services associated with the leased premises, including but not limited to electricity, water, sewer, trash removal, cable, and internet. The tenant agrees to promptly establish accounts for these utilities in their name and to pay all bills in a timely manner throughout the duration of the lease term.
11. Pets Policy: The tenant agrees that no pets of any kind shall be allowed on the premises, including but not limited to dogs, cats, birds, reptiles, and rodents. This policy applies to all visitors and guests as well. Violation of this policy may result in immediate termination of the lease agreement and eviction from the property.
12. Repairs and Damages: The tenant agrees to promptly notify the landlord of any damages or necessary repairs to the premises. The tenant shall be responsible for any damages caused by the tenant's negligence or misuse of the property, excluding normal wear and tear. The landlord shall be responsible for repairing and maintaining the structural integrity of the property and all major systems, such as plumbing, heating, and electrical.
13. Insurance Requirements: The tenant agrees to maintain renter's insurance throughout the duration of the lease term, with coverage of at least $100,000 in liability and $10,000 in personal belongings coverage. The tenant shall provide proof of insurance to the landlord upon request and shall name the landlord as an additional insured party on the policy.
14. Noise Regulations: The tenant agrees to abide by all noise regulations and local ordinances, ensuring that noise levels are kept to a minimum between the hours of quiet hours, 10:00 PM to 7:00 AM. The tenant shall refrain from causing disturbances to neighbors or engaging in any activities that may disrupt the peaceful enjoyment of neighboring properties.
15. Parking arrangements: The tenant shall have access to the 2-car garage and driveway for parking purposes.
