LEASE TERM:
The fixed-term tenancy begins September 23, 2026 and ends September 22, 2027.
The Premises are rented unfurnished.
RENT AND PAYMENT SCHEDULE
No rent is due for September 23 through September 30, 2026.
Tenant shall pay rent according to the following schedule:
October 1, 2026: $1,400
November 1, 2026: $1,400
December 1, 2026: $1,400
Beginning January 1, 2027, monthly rent shall be $1,900 and shall be due on the 1st day of each month for the remainder of the lease term.
The $1,400 rental rate for October, November, and December 2026 is an introductory rental rate agreed upon by Landlord and Tenant at the beginning of the tenancy. The $1,900 monthly rental rate beginning January 1, 2027 is part of the original agreed rental schedule and is not a subsequent rent increase.
LATE RENT
If rent has not been received by the end of the 7th calendar day after it is due, Tenant agrees to pay a $35 late charge to the extent permitted by California law.
The late charge is intended as a reasonable estimate of costs associated with late payment and not as a penalty.
SECURITY DEPOSIT
Landlord acknowledges that Tenant has already paid a security deposit of $1,900.
The security deposit is not prepaid rent and will be held, applied, accounted for, and returned in accordance with California law.
No portion of the security deposit is designated as nonrefundable.
UTILITIES
Landlord is responsible for payment of:
Trash service
Sewer service
Tenant is responsible for payment of:
Electricity
Gas
Water
Internet
Any additional services ordered by Tenant
Tenant shall maintain all required utilities during the tenancy.
FRONT AND BACK YARD
Tenant is responsible for the ordinary maintenance and upkeep of both the front yard and backyard.
This includes reasonable mowing, trimming, watering, weed control, cleanup, and keeping landscaped areas in reasonably maintained condition.
Tenant shall promptly notify Landlord of broken irrigation equipment, water leaks, dying trees, or other conditions that may cause damage to the property.
Tenant shall not remove trees, substantially alter landscaping, or install permanent landscaping without Landlord's prior written approval.
Tenant's responsibility for maintaining the backyard does not grant Tenant any right to enter or use the workshop located in the backyard.
PETS
Dogs and cats require prior approval from Landlord.
A maximum of two approved dogs and/or cats are permitted. This may consist of two dogs, two cats, or one dog and one cat.
Pet rent is $10 per month for each approved dog or cat.
Tenant is responsible for cleaning up pet waste and for damage caused by Tenant's pets.
Legally recognized service animals and assistance animals shall be handled according to applicable law and are not subject to pet rent when prohibited by law.
NO SMOKING
Smoking and vaping are prohibited anywhere on the Premises, including inside the residence, garage, front yard, backyard, and other areas of the property.
This restriction applies to Tenant, occupants, and guests and includes tobacco, nicotine, cannabis, and similar substances, subject to applicable law.
RENTER'S INSURANCE
Tenant is required to maintain renter's insurance throughout the tenancy.
Tenant shall provide proof of renter's insurance upon Landlord's reasonable request.
Tenant understands that Landlord's property insurance does not insure Tenant's personal belongings.
ADULT GUESTS AND UNAUTHORIZED OCCUPANTS
Only the named Tenants and other occupants approved by Landlord may establish residency at the Premises.
An adult guest staying more than three consecutive days, or repeatedly staying at the Premises in a manner reasonably indicating that the adult has established residency, requires prior written approval from Landlord, subject to applicable law.
Tenant shall not allow another adult to move into or establish residency at the Premises without Landlord's prior written approval.
BACKYARD WORKSHOP EXCLUDED AREA
The detached workshop located in the backyard is specifically excluded from the areas rented to Tenant under this Lease.
The workshop is reserved exclusively for Landlord's use and/or storage and is not included as part of Tenant's rented Premises.
Tenant, occupants, children, guests, and pets shall not enter, use, occupy, store property in, alter, open, or otherwise access the workshop without Landlord's prior permission.
Tenant shall not remove, replace, tamper with, or attempt to bypass any lock or other security device on the workshop.
Tenant's right to use and maintain the backyard does not include any right to use or access the workshop.
Tenant shall keep the area immediately surrounding the workshop reasonably clear as part of ordinary backyard maintenance and shall promptly notify Landlord of any visible damage, water leak, attempted break-in, or other apparent problem involving the exterior of the workshop.
Any access by Landlord to the workshop will be handled consistent with applicable California law and Tenant's lawful rights to possession, privacy, and use of the surrounding rented property.
NO SUBLETTING OR SHORT-TERM RENTALS
Tenant shall not assign or sublease the Premises or rent any portion of the Premises to another person without Landlord's prior written approval.
The Premises may not be listed or offered as a short-term rental, vacation rental, Airbnb, VRBO, room rental, or similar arrangement without Landlord's prior written approval.
APPLIANCES
The following appliances are provided by Landlord with the Premises:
Refrigerator
Stove/range
Dishwasher
Landlord is responsible for maintenance and necessary repairs of these appliances except when damage is caused by Tenant, occupants, guests, pets, misuse, abuse, or neglect.
The washer and dryer located at the Premises are being transferred to Tenant for Tenant's ownership and use. They are not Landlord-provided appliances after the beginning of the tenancy.
WASHER AND DRYER TENANT OWNED
The washer and dryer located at the Premises are provided to Tenant as-is and become the property of Tenant.
Landlord makes no ongoing warranty regarding the washer or dryer and is not responsible for maintaining, repairing, or replacing either appliance after transfer to Tenant, except to the extent otherwise required by applicable law.
If the washer or dryer breaks or stops working, Tenant is responsible for any diagnosis, maintenance, repair, or replacement Tenant chooses to perform.
Tenant may replace the washer and/or dryer at Tenant's own expense.
Any replacement washer or dryer purchased by Tenant belongs to Tenant.
Tenant may take the washer and dryer with them when the tenancy ends because the washer and dryer are Tenant's personal property.
Tenant remains responsible for damage to the Premises caused by improper installation, operation, maintenance, or removal of the washer or dryer.
LANDLORD MAINTENANCE RESPONSIBILITIES
Subject to applicable California law and except for damage caused by Tenant, occupants, guests, pets, misuse, or neglect, Landlord is responsible for maintenance and necessary repairs involving:
Water heater
HVAC/heating and air-conditioning system
Garbage disposal
Stove/range
Refrigerator
Landlord shall also remain responsible for repairs and habitability obligations that California law does not permit to be transferred to Tenant.
HVAC / AIR-CONDITIONING FILTER
Tenant is responsible for replacing the HVAC/air-conditioning return-air filter with a new filter of the correct size and appropriate type at least once every two months.
Tenant shall not knowingly operate the HVAC system without the appropriate filter installed.
Tenant shall promptly notify Landlord of HVAC leaks, unusual noises, failure to heat or cool properly, or other apparent HVAC problems.
Tenant may be responsible, to the extent permitted by law, for damage caused by Tenant's failure to perform the required routine filter replacement.
LIGHT BULBS AND MINOR HOUSEHOLD CARE
Tenant is responsible for replacing ordinary light bulbs during the tenancy and performing normal light-duty household care and cleaning.
Tenant shall keep the Premises reasonably clean and sanitary.
Tenant is not responsible for normal wear and tear or repairs that California law requires Landlord to perform.
DAMAGE AND REPAIRS
Tenant shall promptly notify Landlord of leaks, water intrusion, plumbing problems, electrical problems, appliance failures involving Landlord-provided appliances, pest conditions, HVAC problems, or other conditions that may require repair.
Tenant may be responsible, as permitted by law, for damage caused by Tenant, occupants, guests, approved pets, misuse, abuse, or neglect.
Tenant shall not make substantial repairs, alterations, painting, installations, or modifications to the Premises without Landlord's prior written approval.
CLEANLINESS AND TRASH
Tenant shall maintain the residence, garage, yards, and other areas of the Premises in a reasonably clean and sanitary condition.
Tenant shall properly dispose of household trash and shall not allow excessive trash, debris, or other materials to accumulate on the property.
ALTERATIONS
Tenant shall not paint, remodel, install permanent fixtures, modify plumbing or electrical systems, install satellite equipment, or otherwise materially alter the Premises without Landlord's prior written approval.
KEYS AND LOCKS
Tenant shall not change, rekey, or replace exterior locks or install a locking device that prevents Landlord's lawful access without Landlord's prior written consent, except where otherwise permitted by California law.
All keys, garage remotes, and other access devices provided by Landlord shall be returned when Tenant vacates the Premises.
LANDLORD ENTRY
Landlord may enter the rented Premises only as permitted by California law, including for lawful inspections, necessary or agreed repairs and services, emergencies, showing the property when legally permitted, abandonment or surrender, and other purposes authorized by law.
Landlord shall provide legally required notice when applicable.
MOVE-OUT
At the end of the tenancy, Tenant shall remove personal belongings and trash, return all keys and remotes, and surrender possession of the Premises.
Tenant shall leave the Premises in the condition required by California law, ordinary wear and tear excepted.
The security deposit and any deductions will be handled according to California law.
COMPLIANCE WITH LAW
Nothing in these additional terms is intended to waive any right or obligation that cannot legally be waived under California law.
If any provision conflicts with applicable law or a mandatory provision of the primary lease, applicable law and the lawful provisions of the primary lease shall control.
