1. Lease Term- Lease is a standard 12 month residential lease
2. Monthly Rent- Tenant shall pay $1.995.00 (One Thousand Nine Hundred Ninety Five Dollars) per month in lawful U.S. currency, due on or before the first (1st) day of each calendar month. Rent shall be paid without demand, deduction, or offset.
3. Security Deposit- Tenant shall pay a security deposit equal to two (2) months' rent, due in full prior to move-in. The security deposit shall be held by Landlord in accordance with Florida Statutes 83.49 and may be applied toward unpaid rent, damages, or other lawful charges.
4. Utilities and Services- Tenant is responsible for payment of all utilities and services associated with the property, including but not limited to electricity, water, gas, trash, internet, and cable.
5. Smoking Policy- No smoking is permitted on the premises at any time. Violation of this provision constitutes a material breach of the lease and may result in immediate termination.
6. Pets Policy- No pets are permitted on the premises at any time. Violation of this provision constitutes a material breach of the lease and may result in immediate termination.
7. Homeowner's Association (HOA)- The Property is located within a community governed by a Homeowners Association (HOA). Tenant agrees to abide by all HOA rules, regulations, and policies. Any fines or penalties assessed by the HOA due to Tenant's actions or negligence shall be the Tenant's sole responsibility.
8. Furnishings and Appliances- The Property is unfurnished, but includes standard household appliances (refrigerator, oven/range, dishwasher, and washer/dryer). Tenant shall maintain all appliances in clean working order and promptly notify Landlord of any malfunction or needed repair.
9. Lease Renewal- At the end of the initial term, this Lease may automatically renew on a month-to-month basis or for an additional twelve (12) month term, at the Landlord's discretion, unless either party provides written notice of non-renewal at least sixty (60) days prior to the expiration date.
10. Late Payments-
A. First late payment: A one (1) week grace period will be provided.
B. Second late payment: A $200 late fee will be assessed if rent remains unpaid after the grace period. An additional $100 fee will apply for each subsequent week rent remains unpaid.
C. Third late payment: Rent will permanently increase by $150 per month, effective immediately, in addition to the above late fees.
D. Future late payments: Each subsequent late payment will result in an additional permanent rent increase of $150 per month and continued application of all late fees described above.
11. Default- Failure to pay rent, violation of HOA rules, or breach of any term herein shall constitute default under Florida Statutes Chapter 83, giving Landlord the right to terminate this Lease and seek possession through lawful eviction procedures.
12. Governing Law- This Lease shall be governed by and construed in accordance with the laws of the State of Florida, including Florida Residential Landlord and Tenant Act (F.S. 83.40 83.682).
