This is a one-year (12 month) lease. According to Sec. 91.001 to terminate tenancy the Landlord or Tenant must give the other party a written one (1) month notice of Lease non-renewal. The Tenant may only terminate their Lease on the last day of any month and the Landlord must receive a written notification of non-renewal at least one (1) month prior to the last day of that month. If the Tenant plans to leave on or after the first of any month, they are responsible for that month's full rent. If the Tenant does not provide the Landlord with a written one (1) month notice, they shall forfeit their full deposit amount.

Tenant agrees to pay Landlord as rent for the Premises the amount of two thousand dollars ($2,000.00) each month in advance on the 1st day of each month. First month's rent and security deposit is due at lease signing.
If the Lease Term does not start on the 1st day of the month or end on the last day of a month, the first and last month's rent will be prorated accordingly.

Rent is due on the 1st of each month. If any or all of the rent is not received by the 7th of the month, $50 per day will be charged as late fees until full rental payment is received. If rent is not received by the 15 of the month, Tenant will be considered in breach of the Lease Agreement and eviction proceedings will be initiated.

Rent payment must be made through private Venmo transactions, no exceptions.

Tenant agrees to pay the charge of $50 for each check given by Tenant to Landlord that is returned to Landlord for lack of sufficient funds.

At the signing of this Lease, Tenant shall deposit with Landlord, in trust, a security deposit of $1,000 as security for the performance by Tenant of the terms under this Lease and for any damages caused by Tenant, Tenant's family, agents and visitors to the Premises during the term of this Lease. Landlord may use part or all of the security deposit to repair any damage to the Premises caused by Tenant, Tenant's family, agents and visitors to the Premises. However, Landlord is not just limited to the security deposit amount and Tenant remains liable for any balance. Tenant shall not apply or deduct any portion of any security deposit from the last or any month's rent. Tenant shall not use or apply any such security deposit at any time in lieu of payment of rent. If Tenant breaches any terms or conditions of this Lease, Tenant shall forfeit any deposit, as permitted by law.

Unless otherwise specified in this lease all notice shall be in writing and shall be delivered to the other party by email.

Landlord may evict Tenant from the premises or undertake other legal action to regain possession for non-payment of rent, utilities, or other charges, abandonment, violation of the provisions dealing with occupancy, use, assignment/subletting, noise and nuisance, pet provisions, destruction of the property or other breach of this lease.
Tenant shall continue to be liable for rent and be bound by the other provisions of this lease, even though Landlord have chosen to seek eviction because of breach of the lease agreement.
If Tenant is continuously absent from the premises, without prior explanation to Landlord of the reason for the absence, for 10 or more continuous days while all or any portion of the rent is unpaid, Landlord shall have the right to deem the premises abandoned. In this case, Landlord may enter the premises and may remove Tenant's belongings, so long as there is no breach of the peace.
If the premises are abandoned or if the Tenant is evicted, Tenant will remain liable for any loss of rent for the remainder of the lease's term. Landlord may re-let the premises under these circumstances for such rent and upon such terms as Owner deems reasonable and advantageous without affecting Tenant's liability under this Provision 7.
If Landlord obtains possession of any of Tenant's belongings, under 7C above, Landlord shall make a reasonable effort to notify Tenant of such fact. If Tenant fails to assert any Ownership interest in the belongings for a period of one month, Landlord may dispose of or sell the belongings in any manner, and the proceeds of any sale shall belong to the Landlord.
Tenant agrees at the expiration of this lease to peacefully surrender and deliver the leased premises to the Landlord. In the event the Tenant holds over beyond the expiration date of this lease without the written consent of the Landlord, the lease shall not be deemed renewed. Tenant shall be regarded as Tenant at Sufferance and shall be liable for a daily holdover charge in the amount of $50 an hour until possession is returned to the Landlord. If the Tenant does not leave at the end of this lease and other Tenant is waiting to move in, Landlord, after notifying Tenant may remove Tenant's belongings, however Landlord shall not be obligated to store said belongings and shall have no responsibility to Tenant with respect to said items so removed. Landlord will be responsible to Tenant for any type of bailment in relation to said property. Tenant will be responsible for any losses suffered by Landlord or any person (s) who had to wait for Tenant to vacate in order to move-in, and all legal fees associated with the holdover.

Only those persons named on the lease may reside on the leased premises. Tenant may not allow guests to stay on the premises for more than 10 days per month, without written consent of the Landlord.

Tenant shall use the premises for residential purposes only (remote employment excepted). Tenants shall not engage in any illegal activities on the premises.

Absolutely no smoking of any kind (vaping is fine) inside the unit at any time, any indication of smoking inside the unit will be met with a fine of $100 per infraction.

Feminine products, condoms, paper towels, hygienic wipes, q-tips, cotton balls, toys and towels shall NOT be disposed of, flushed or discarded in toilets or sinks on the premises. If plumbing or other problems or damages result therefrom, repairs will be charged to the Tenant.

Tenant, at Tenant's expense, will maintain the yard. "Yard" means all lawns, shrubbery, bushes, flowers, gardens, trees, rock or other landscaping, and other foliage on or encroaching on the Property or on any easement appurtenant to the Property, and does not include common areas maintained by an owners' association. "Maintain the yard" means to perform activities such as, but not limited to: (a) mowing, fertilizing, and trimming the yard; (b) controlling pests and weeds in the yard; and (c) removing debris from the yard. Tenant will water the yard at reasonable and appropriate times according to city watering schedule.

Tenants shall be responsible for the following utilities or services connected with the premises: Electric (City of Austin), Water/Sewage/Trash (City of Austin), Phone, Cable/Internet. Within 3 business days after the beginning of the lease term, Tenant shall arrange for such utility services, hookups and for billing directly to Tenant.

Tenant shall permit and Landlord shall have the right to enter the premises at reasonable times and upon reasonable notice for the purpose of making necessary repairs, alterations or improvements, to supply services as agreed, to make reasonable inspections and regular maintenance or to show the premises to prospective Tenant, purchasers or lenders.

Entry may be made without prior notice only if Landlord reasonably believes that an emergency exists, such as a fire or broken water pipe, or that the premises has been abandoned.

Tenant shall not assign this lease, or sublet any portion of the premises for any part or all of the term of this lease without prior written consent of Landlord.

All neighborhood residents have the right to use and enjoy their property without interference or nuisance. Tenant may not create or allow any nuisance, including but not limited to excessive noise, litter, debris, trash, or graffiti on or to the property.

Before, at the time of taking possession of the property, or shortly thereafter, Landlord and Tenant agree to inspect the property and prepare a move-in checklist identifying any present damages or needed repairs. If Tenant fails to cooperate in the inspection, Tenant shall be prohibited from asserting that any damages or need for repairs existed at the premises as of the date of occupancy.

If repairs are required at any time during Tenant's occupancy, Owner shall be responsible for making such repairs. Tenant shall not make repairs without prior written consent of Owner. Tenant shall pay reasonable charges for the repair of damage to the premises caused by the negligence or willful acts of Tenant or guest. Such charges shall be due and payable upon demand by Owner. Excessive damage to the premises by Tenant shall be grounds for Owner to evict.

Tenants will not make any alterations to the premises including, for example, painting, adding or changing door locks, installing plant hangers or toggle bolts without the express written consent of the Landlord.

A maximum of 4 total cats and/or dogs are allowed, for an additional monthly fee of $25 per cat/dog.
The Tenant are responsible for all damages related to or caused by the pet. In this regard, Tenant are required to notify Owners of such damages immediately and shall promptly repair said damages and/or restore the property to its original condition at their sole expense from funds other than the "Pet Deposit".
Tenant shall keep the pet under control at all times and prevent the pet from engaging in behaviors or creating excessive noise, that is a disturbance or nuisance to others.
Tenant are required to keep all areas of the property clean and free from parasites such as fleas. If de-infestation is necessary at any time during the tenancy, it shall be the responsibility of the Tenant to have the property professionally cleaned. Pet feces must be promptly removed and disposed of.
The Tenant shall provide adequate veterinary care, as well as food and water and shall not leave the dog unattended for any undue length of time.
The Tenant shall maintain the yard and clean up pet waste in a timely manner so as to avoid the accumulation of excess pet waste and yard damage. Landlord has the right to hire landscape professionals to remedy any damage to the yard from pet waste, with services paid for by the Tenant.
The Tenant agrees to indemnify, hold harmless, and defend Owners and Owner's Property Manager against all liability, judgments, expenses (including attorney's fees), or claims by third parties for any injury to any person or damage to property caused by the pet.

Landlord's insurance does not cover Tenant's personal possessions in the event of loss or damages due to fire, windstorm, flood, theft, vandalism or other similar cause. The Landlord shall not be liable for any damage or injury, occurring on the premises, and the Tenant agrees to hold the Landlord harmless from any claims or damages unless caused solely by the Landlord negligence.
Tenant is required to obtain renter's insurance and show proof to Landlord within 10 days of occupancy.

If a dispute arises during or after the term of this lease between Landlord and Tenant, the parties agree to attempt to engage in good faith negotiations to resolve the dispute prior to any litigation.
The unenforceability of any provision of this lease shall not affect the enforceability of any other provision or provisions.
If this lease is signed on behalf of the Tenant by more than one person, the liability of the person signing shall be joint and several.
Unless caused by Landlord, Landlord is not responsible to Tenant, Tenant's guests, family, or occupants for any damages, injuries, or losses to person or property caused by fire, flood, water leaks, ice, snow, hail, winds, explosion, smoke, interruption of utilities, theft, burglary, robbery, assault, vandalism, other persons, condition of the Property, environmental contaminants (for example, carbon monoxide, asbestos, radon, lead-based paint, mold, fungus, etc.), or other occurrences or casualty losses. Unless prohibited by law, Tenant will promptly reimburse Landlord for any damages, injuries, or losses to person or property caused by Tenant, Tenant's guests, any occupants, or any pets or assistance animals, including cost of repairs or service to the Property.

HOA governing documents will be provided to Tenant. Any fees incurred by violations of HOA guidelines will be paid by the Tenant. Notably the garbage bins must be placed out of sight of the street after waste has been removed and the front lawn needs to be maintained.
