Utilities and Services:
Landlord Responsibilities: The Landlord shall be responsible for paying for the following utilities/services: [Quarterly Pest Control and Wi-Fi].
Tenant Responsibilities: The Tenant shall be responsible for paying for the following utilities/services: [Water/Sewer, Garbage, Electrical]. Unless a separate agreement of utilities provided is entered into, in writing, with the Landlord.

Maintenance and Repairs:
Landlord Responsibilities: The Landlord is responsible for maintaining the property in a habitable condition and complying with Oregon habitability requirements (ORS 90.320). The Landlord will be responsible for major repairs including but not limited to, plumbing and heating systems, weatherproof roof and exterior walls, functioning electrical systems, and clean and sanitary common areas. The Landlord shall make necessary repairs within a reasonable time frame.
Tenant Responsibilities: The Tenant is responsible for keeping the property clean and free from debris. The Tenant is also responsible for minor maintenance tasks such as changing light bulbs, batteries, and disposing of trash properly.
The Tenant is responsible for testing smoke and carbon monoxide detectors every six months
Tenant is responsible for charges that require a locksmith necessary at the property
Reporting: Tenant agrees to promptly report any necessary repairs to the Landlord in writing.
Alterations: No alterations or improvements shall be made to the property without the prior written consent of the Landlord.

Use of Premises:
Residential Use: The property shall be used solely as a private dwelling for the Tenant(s) and any approved occupants listed in this agreement.
Occupancy: All Tenants will be required to complete a Tenant Information Form
and only the tenants listed in this agreement and their minor children may reside at the property. Anyone 18+yrs of age staying longer than 5 days must be disclosed and an additional Tenant Information Form must be completed.
Subletting: Subletting is prohibited under this agreement.
Illegal Activities: The Tenant shall not engage in any illegal activities or allow any illegal activities to take place on the premises.
Fair Housing: Landlord and Tenant agree to abide by all applicable fair housing laws and regulations, including the Fair Housing Act.

Entry to Premises: Per (ORS 90.322) Landlord or agent access to premises:
Landlord's Right to Enter: The Landlord may enter the premises after providing at least twenty-four (24) hours' notice to the Tenant, except in cases of emergency.
Valid Reasons for Entry: Valid reasons for entry include, but are not limited to, making necessary repairs, inspecting the property, showing the property to prospective tenants, or responding to emergencies.

Pets (if applicable):
Pet Policy: Pets may be allowed with permission by the Landlord for each pet.
Landlord may charge an extra pet deposit, but not for service animals or companion animals required by a tenant with a disability (proof will be required)

No Smoking Policy:
No Smoking Premises: Smoking of any kind, including but not limited to cigarettes, cigars, marijuana, electronic cigarettes, and vaping devices, is strictly prohibited inside the dwelling, garage, and any enclosed areas of the premises.
Outdoor Areas: Smoking is restricted to outside areas free of any open doors or windows that would allow smoke to penetrate the inside of the unit. This includes all outdoor areas directly adjacent to the property, including patios, decks, porches, and yards, unless specifically designated by Landlord in writing.
Tenant Responsibility: Tenants are responsible for ensuring that household members, guests, and invitees comply with this No Smoking Policy.

    "I love my neighborhood cuz Is peaceful, safe, great for walk , and excellent for raise kids, also a have to admit that (Fairview apartments) a cross the street they got some renters that they bring shopping cars, they smoke weed and drink alcohol at the sidewalk, and they always leave the cars not well parked, and as a home owner I almost never get parking in front of my house, guess what? cuz the neighbor a cross the street they used , of course the street is public but, we as a home owner we have a rights, I believe (Fairview apartments management needs to put serious attention on this) "
