The tenant(s) agree to the following terms:
1. To use said premises as a residence only.
2. The rental of the townhome is with a 1 (one) year minimum rental at $2,200/month due the 1st of each month. The first month's rent will be prorated based on the number of days the tenant occupies the unit. If rent is not paid by the 5th of each month, there will be a $25 late charge. If rent is not paid by the 10th of each month, there will be a $50 late charge.
3. Early termination of the rental agreement will result in a fee of $2,500.00 plus the rent due through the last calendar day of the month the tenants live in the property.
4. Tenant shall give the owner/manager 30-day notice to vacate the premises. In the event less than the above notice is given, tenant will pay additional rents to cover notice period. Upon termination, tenant will return all keys and garage door opener and notify the owner/manager when vacant to provide for final inspection.
5. The deposit total, due at the time of signing this lease contract, will be $2,000. Following the tenant vacating the premises, this amount will be refunded, less the cost of repairs, cleaning, and/or damages, following timelines as directed under applicable laws.
6. Tenant agrees to vacate premises within 3 days after being notified in writing due to non-payment of rent, breach of this agreement, or any other reason deemed prudent by the owner/manager.
7. There is a no-pet policy; however, exceptions may be made for approved pets under 25 pounds with a $350 non-refundable deposit, plus a monthly $25 fee for each pet. Costs associated with repairing property damage caused by a pet will be the sole responsibility of the Tenant.
8. Upon occupancy, tenant will examine unit and fixtures and shall report, in writing, any defects or damages to the owner/manager within 72 hours from the date of occupancy. Without said report, it will be assumed the unit is in acceptable conditions.
9. Tenant will keep plumbing fixtures and garbage disposal in the premises clean. It will be the responsibility of the tenant for all costs associated with the clearing or cleaning any partial or complete stoppage occurring during the period of the agreement caused by negligence of the tenant.
10. Tenant will comply with using the following in a reasonable manner: electrical, plumbing, sanitary, heating, ventilating and other facilities and appliances.
11. To ensure proper working order, owner/manager will inspect smoke/carbon monoxide detectors, all major appliances, and replace the furnace filter once every 3 months.
12. It is understood and agreed that the owner/manager shall have the right to enter and inspect premises at all reasonable times to ensure maintenance and safety of premises. Owner/manager will notify tenant at least 24 hours in advance of entry to the property. Tenant acknowledges emergency situations may occur in which the owner/manager needs to enter the property without a 24-hour notice. In an emergency, owner/manager will make every effort to notify the tenant as soon as possible.
13. No alteration of any kind to the house shall be made without prior written consent from the owner/manager.
14. It is expressly understood and agreed that the owner/manager of said premises will not be liable for any damages or any injury to tenant or property from whatever cause arising from the occupancy of said premises.
15. The tenant shall not transfer or assign their interest in this rental agreement.
16. The tenant shall provide rental insurance to the manager(s). Tenants shall not keep or have on the premises any article or thing of a dangerous, inflammable, or explosive character that might unreasonably increase the danger on the leased premises or that might be considered hazardous.
17. No illegal drugs are allowed.
18. An annual rent increase may occur but will not exceed $100/month.
19. The following items are included in this Agreement and are to be left in the same condition as they are at the time of occupancy when this agreement is terminated: Refrigerator, Range/Stove, Dishwasher, Microwave, Washer/Dryer, Garbage Disposal, Air Conditioner, Garage Door Openers and Fire Detector/Carbon Monoxide Detectors.
20. The tenant is responsible for the following utilities: Electricity, Water, and Phone/Cable. It is the responsibility of the tenant to have Electricity, Water, and Phone/Cable transferred into his/her name prior to occupying the unit. At no given time should the Electricity ever be turned off.
21. The owner is responsible for paying for the following utilities: Lawn Care, Sprinkler System, Snow Removal, Garbage & Recycling (all such utilities are covered in the Home Owners Association Monthly Fee, which is paid by the owner)
a. Lawn Care Mowing & Fertilizing
b. Sprinkler System Spring & Fall maintenance, scheduling water times.
c. Snow Removal Driveways, sidewalks & private streets
d. Garbage picked up weekly. Recycling picked up bi-weekly.
e. Garbage & Recycling are picked up on Wednesday's.
f. The current HOA Service Providers (*Service Providers & Schedules are subject to change)

22. Deposit check cannot be used to pay the last month's rent when vacating. When the house is vacated the owner/manager will check for damage and if cleaning has been properly done. It is the responsibility of the tenant to have the carpets professionally cleaned upon vacating the premises. If the house is in the same condition as when the tenant moved in, the remainder of the deposit will be returned. If cleaning needs to be done by the owner/manager, $45/hour for cleaning will be deducted from the deposit.
23. For safety and cleanliness reasons, no smoking is allowed on the premises.
24. All Home Owner Association By-Laws and Rules and Regulations must be followed. See attached.
25. There is a limit to two (2) vehicles per single garage unit. Tenant shall provide their vehicles year, make, model and color to the Owner/Manager within 30 days of signing this lease agreement. This information will be submitted to the Home Owner's Association so they can ensure vehicles are not parking in the visitor parking.
26. The violation of any of the conditions of this agreement shall be sufficient cause of eviction from said premises. Tenants agree to pay all costs of such action, including such reasonable attorney's fees that may be fixed by court.
27. These rules and regulations may be added to or amended from time to time by the owner, and such amendments will become effective immediately upon notification to the tenant.
