LEASE TERMS

1. RENTAL UNIT & LENGTH OF LEASE: 2-bedroom house at 1623 Josephine Street, Berkeley, CA 94703. 1-year lease after which it may renew as a year-year or a month-month contract.

2. RENT: Rent of $3,500 per month is payable in advance on the 1st day of each month and is delinquent after the 5th day. Rent shall be paid via Venmo or Zelle.

3. SECURITY DEPOSIT. $1,500. Security Deposit will be returned to Lessees less any amount for damages to the Property within 21 days of last day of occupancy, after Lessees have vacated the Property and keys have been returned.

4. QUIET ENJOYMENT: Lessees and guest(s) shall not violate any law, ordinance or statute in the use and occupancy of the Property, commit waste or nuisance, annoy, molest or interfere with any other person on the property, or neighbor.

5. REPAIRS, ALTERATIONS AND DAMAGE: Lessees should submit requests to Property Manager for major alterations or repairs and must notify in the case of damage. Property Manager is responsible for hiring gardener and repairpeople.

6. CARE, CLEANING, MAINTENANCE AND INSURANCE: Lessees agree to leave the premises in the same condition as it was received, subject to normal wear and tear. Lessees's property will be insured under Property Manager's rental policy, Lessees is also encouraged to obtain their own insurance, especially if they have high value items.

7. SMOKE DETECTION DEVICE: The Property is equipped with smoke detection devices and Lessees shall be responsible for testing the device and immediately reporting any problems, maintenance or need for repairs to Property Manager.

8. SUBLETTING AND ASSIGNMENT: The Property shall be occupied only by the renters listed on the contract. No portion of the premises shall be sublet nor this Agreement assigned. Any attempted subletting or assignment by Lessees shall be an irremediable breach of this Agreement and cause for immediate termination.

9. SMOKING: Smoking is prohibited in any area inside the house.

10. EARLY TERMINATION: Lessees may upon 30 days written notice terminate this Agreement. All rent due must be paid until the new termination date. This Agreement may also be terminated by the Property Manager with a written 30-day notice of termination.

11. UTILITIES AND SERVICES: Utilities (East Bay Mud + PGE) are the responsibility of the Lessees as it varies by usage. Garbage is included in the rent.

12. PETS: Pets are allowed on the property, but are not permitted to pee on the grass in the backyard. No additional pet fee is collected in addition to the deposit.

    "I lived here for 5 years and it's a great area for families. There are lots of resources and events for everyone: the farmer's markets, the schools are great, lots of daycare options and playgrounds for little ones. The student presence is diminished due to the high cost of living in this area, but not gone. The cultural vibe is similar to most of Berkeley, great most of the time with the occasional run-in with an entitled former hippy who elbows you out of the way to get at their organic melon at Monterey Market. For some reason, everyone thinks they can cross the street whenever and where ever they please. Otherwise a great area for food, evening strolls and hanging out with the family"

    "I've lived here since 1987. Buying a home here was the best thing for me and my family. We live a 10 minute walk to North Berkeley BART and to great bus transportation on San Pablo Ave to both San Francisco and all parts of the East Bay. Our street is very quiet with good neighbors. Berkeley Adult school offers lots of interesting day, evening and weekend classes. Acme bakery has the best bread and Cafe Leila's outdoor patio and excellent food are always worth a visit. Monterey Market is not far and Solano Avenue and 4th Street shops are just a short drive. Cedar Rose park is also an easy walk for a children's play area and grassy fields for soccer, volleyball or just picnicking. Northwest Berkeley offers the best living for middle income families who want a safe, friendly, clean and accessible place to make their homes."

    "We moved here from San Francisco's Richmond District and in comparison, there leaves a lot to be desired. I am not accustomed to TRASH being littered everywhere. Little Caesar's pizza boxes and Popeye's trash is found everywhere around here. The worst is after garbage day, when people put whatever they want on the corner, hoping the garbage truck will haul it away but they don't, so it stays on the corner for weeks. Traffic on either University or San Pablo can be horrendous on weekends, so you need to be savvy about using side roads to get around by car or bike. Parking can also be a hassle, especialy when the Casa De Cultura has classes or events going on. On the positive side, I'm within walking distance to Fourth Street shopping, like Sur La Table, Benefit Cosmetics, M.A.C. Cosmetics, Anthropologie, and Paper Source. There are decent restaurants within walking distance, like La Mission, Kabana, Your Place Thai Cuisine, Priya Indian Cuisine, Lanesplitters Pizza, and others that I have not tried yet (Local 123, Luca Cucina Italiana, The Cheese Steak Shop). I'm within walking distance to 2 bars: Albatross Pub and Acme Bar so there's some nightlife around here. I've found that I can walk around the neighborhood safely, which is important as a young woman. There are bike routes nearby, which can take you to the Berkeley Marina, Emeryville, downtown Berkeley, or Albany in mere minutes. I also like being a 10 minute walk from North Berkeley BART station, since it beats sitting in traffic on I-80. It's not as clean (amazingly) as our old neighborhood and we're no longer a 10 minute walk from a national park like we once were, but we do like our new neighborhood, flaws and all. "

    "I've lived in several locations around this area, for over twenty-five years total. I like it, but as far as 'safety,' there's more to safety than sheer violent crime, such as people who patronize the University/SanPable area shops, and wander around in the general area. You will definitely see more displaced and/or seedy individuals walking up and down Berkeley Way and Hearst - streets very near University, than on streets farther away. In addition there have been more real prostitute and drug rings on both streets over the last twenty-five years than farther away. My kids have tended to avoid those streets up to Sacramento - telling me about these things themselves over time. In general it's a safe area, but don't be too naive to believe the University and San Pablo corner doesn't influence things for the worse at times for nearby residents. "
