4. Security Deposit: The Tenant shall pay a security deposit of $5,000.00 prior to moving in. This deposit is held as security for any damages caused to the Property, beyond normal wear and tear, and for any unpaid rent or utilities. The security deposit will be returned within 31 days after the Tenant vacates the Property, less any allowable deductions.
5. Utilities: The Tenant is responsible for all utility services required on the Property, including but not limited to water, gas, electricity, internet, and trash. The Tenant shall arrange for these services and pay all charges directly to the utility providers.
6. Maintenance and Repairs: The Tenant is responsible for maintaining the Property in a clean and habitable condition. The Tenant shall promptly report any damages or needed repairs to the Landlord. The Landlord is responsible for repairs due to normal wear and tear and for maintaining the structural integrity and safety of the Property.
7. Pets: The Tenant is allowed to keep small pets on the Property, subject to the following conditions:
An additional pet deposit of $50 /month is required.
Pets must be kept under control at all times and should not cause any damage to the Property or disturbance to the neighbors.
The Tenant is responsible for any damage caused by the pets and for keeping the Property clean and free of pet waste. Tenants with pets must ensure that their animals do not create excessive noise or disturbances. This includes, but is not limited to, barking, whining, or any other noise that may disrupt the peace of the property.
8. Smoking: No smoking is allowed anywhere on the Property, including both indoor and outdoor areas. This includes the front yard, backyard, and any other outdoor spaces associated with the Property.
9. Right of Entry: The Landlord may enter the Property with at least 24 hours' notice to the Tenant, or immediately in case of emergency, to inspect, repair, or show the Property to prospective tenants or buyers.
10. Subletting: The Tenant may not sublet the Property or assign this lease without the prior written consent of the Landlord.
11. Termination: The Tenant must provide a written notice of intent to vacate at least 30 days prior to the end of the Lease Term. Early termination of the lease may result in forfeiture of the security deposit, unless otherwise agreed upon by the Landlord.
12. Compliance with Laws: The Tenant agrees to comply with all local, state, and federal laws, regulations, and ordinances during the Lease Term.
13. Dispute Resolution: In the event of any dispute arising from this Agreement, the parties agree to first seek mediation. If mediation fails, the dispute shall be resolved in accordance with the laws of the state of Oregon.
