We have two small markets already and another one is coming soon. They are all located on the main road that goes through Valley Center. A regular sized grocery store is also in the works but we don't have a date on that yet. Meantime, Von's, Ralph's, Albertson's and two other grocery stores are nearby in Escondido, with Fresh 'n Easy and a Henry's nearby. That said, do the CC&R's change your desire to live at the home??? That is the question here. If it really doesn't change anything, I'd probably write some angry letters and get on with my life.

If however, these documents do materially change your desire to live there then you should probably seek legal recourse...

Do you live here in the U.S.? If so, how long? Are you here on a Visa? If so, what type of Visa? Are you employed here? If so, for how long have you received income/reported income on your tax returns?

Or... do you live in Canada and do not have any permanent or non-permanent residency in the U.S.?

Depending on which will determine what options there are.

If it is your primary residence, I would try a short sale. Even if it does not work, at least you have tried. It will save your credit some, and any consequences will be lessoned.. We always recommend seeking legal advice, but everything points to short sale.

Many feel much mor comfortable working with their own agent as opposed to one that is representing both the seller and you.

If you really trust your present agent....perhaps it is time for a down to earth conversation about your needs, his/her service, and your motivation to buy now. Ask them to honestly, tell you why you have been unable to find a home after nearly a year of looking.

Do you need to adjust your expectations, change your focus, or throw more money in the pot? A concersation that is open and honest can only help your situation..try this before anything else....
