I would say, first contact your attorney, and then contact a qualified inspector to see if he can figure out where the issue lies and how/if it can be corrected.

It's best to have an analysis done ... or a "new purchase" appraisal. Generally speaking, if it was a steal for a developer (or an otherwise great opportunity), they would have already contacted you. If the lot is in the flood zone value will be affected.

The reason I ask is that, many times, unless the buyer is willing to commit to an agent as his or her representative, the agent is unlikely to expend too much time looking for the buyer. Like others, I'll email listings to clients who have expressed, for example, an interest in a 3 bedroom home in Santa Clara, California, but who have not expressed a desire to work exclusively with me. For those who are active buyers, who have worked with me exclusively and who have signed Buyer/Broker representation agreements, they have my full, undivided attention to their housing needs and search. I will daily search the MLS for suitable homes for them, will preview houses before showing the homes to them, review the comparables, check the disclosures and know everything about the home before I suggest anything to the client.

Otherwise, I've learned from experience that a buyer who will not sign such a buyer broker agreement is usually not that serious in working with me at this time, so we keep the relationship casual and open-ended until the buyer is ready to make such a commitment. In today's home buying environment, as you are now finding out (and others do too, but it takes time and exposure to the market), one must be "serious" about a house hunt in order to be successful. To do this, you, as the buyer, must make serious commitments to buy with a qualified, experienced and willing agent.

Interview a few agents, be upfront about your needs and expectations, and then be willing to make a commitment to work with and hire an agent, and I'm certainyou'll see a huge difference in the type of service you receive from that agent. Good luck!

I'd recommend two things ... first, try to be at the location at morning, afternoon and evening time. Beauty is in the eye of the beholder ... music to some, noise to others. I'd be sure to check for yourself to ensure that you are satisfied with the result - definitely don't depend on a third party opinion (this is from someone who once had a train in the backyard - it's not noisy after the first week :)).

Resale can be tested by looking at comparable sales. Look at recent sales of similar homes ... did they sell for more or less? If you cannot find similar homes to this (in the same general area), look at other sales near your prospective home and find com parables for it ... this will help you determine the percentage difference.

I'm not sure about the legality, but the MLS does now require that this information be disclosed. I do believe that ethically speaking, it should have been disclosed. West Newton has a lot to offer if you are looking for a walkable location with shopping, restaurants, movies and easy access to transportation routes. These atributes are available in the Highlands, with the exception of the theatre. Newton corner is a little less walkable. Newton center is tough if you need to get to the highway during commute times, but does have the MBTA Greenline if you are so inclined. If I were looking at the villages I'd take a half day in each one to get a real feel for the lifestyle and see how it appeals to me. Best to you in your search! ... more

As a homeowner, I have a shared driveway with my neighbor. That house has had 2 owners since I bought my house in 1996 and I've never had a problem. We share the plowing costs and we have extra parking for guests since the driveway is oversized.

As a Realtor, it is ultimately up to the buyer to just know going into the situation that the house has a shared driveway. If you have not done so already, it may benefit you to ask the question of how the driveway is maintained between the two owners now, when it was last paved, etc.
