Your name is likely still on the deed and you want to do everything you can to get off of it as quickly as you can.

Gri0500,
As a former lender, I'm not aware of any required period of living in a home to call it your primary residence for refinance purposes. You will be signing an affidavit swearing that everything on your loan application is true, so if you move in for 30 days, refinance as a primary residence then move out and the lender checks on you, you could be challenged. If you plan to stay, I say go for it.
Talk to your lender when you apply however just to be certain. Rules change so fast it's hard to keep up with them.
