I have never had that occur, it is still going to be sold whether by Sheriff's sale or Bank so typically you cant get it back. However I did know of a fellow that was losing his house and the family was able to buy it as a short sale from the bank in time before the foreclosure process. I hope all works out.

Merchantville is a great little town. The problem is like most little towns they don't have the resources paying taxes that will support the school system. Unlike Mount Laurel Twp or Evesham Twp they don't have the population or tax base in the area to support the type mega schools in those two townships. Merchantville is surrounded by Pennsauken, Camden and Cherry Hill all very large districts which is not what the parents want for their children. Years ago Merchantville tried to join with Haddonfield but the number of added students would have overburden the Haddonfield schools also Pennsauken would not let them go because of the thousands of dollars (near $12,000 per student per year) that Merchantville pays Pennsauken to allow the Merchantville student to attend the sub-par Pennsauken system.

I grew up in Glassboro my wife is from Ocean City and we lived in Haddonfield for 15 years. We live in Charlotte NC with a Regional school system with large high schools not unlike Cherry Hill, Shawnee and Cherokee high schools. I like the parents in Merchantville prefer the smaller school systems.

If the prospective buyer has walked away or thinking about it after the bank has approved the short sale try to find out the actual reason for deciding not to purchase the home. Did he/she just get cold feet and need some assurances or is it their mortgage company having a problem with his/her paperwork?
There maybe things to be done. If by any chance the buyer still does not want the house any longer then your Realtor can put the house on the market again and advertise it that it got approval and waiting for the right buyer.

It likely means that the source feed of the listing has expired - my suggestion to you is to contact the broker/agent to ask specifcally about the status of the property.

Time frames vary after the NOD. The next step is to set the trustees sale date (foreclosure sale date) but it can take several months for the bank to do so and it is typically three months from when they to file. Sometimes the bank will work with the borrower extending these dates while working on a loan MOD or short sale.

What is hard to understand, is where you are getting the data from. There usually is not an end date to a Lis Pendens(pre-foreclosure) Filing. If you are using various free websites, most likely the information is not correct. It is difficult to answer your questions without know what you are looking at for the information. If you want, email me the address, and I can look up the actual filing for you and email it you. I pay for this service, so the data is more complete and accurate. This way you will have the most accurate data available for whatever you are looking to accomplish. Hope that helps. ... more

If the seller has instructed his or her agent to do so, then it is legal. I have had sellers that have instructed me to tell any potential buyer that they will not accept less than $^&^& for their property. This would take place between agents as a rule. If we are in the middle of a counter and the seller says, "tell them my final offer is "x" amount and then the other agent says to me that their buyer is thinking of writing a counter for "x" amount, then this would be appropriate for me to tell them this information.

However, without knowing exactly what transpired, and from this limited information, it is difficult to give you a complete answer. You may have been thinking of offering a higher price than what you were told and that could present a problem, but without more details, I cannot say.
