Hi, Taxes are based on assessed market value by the town. Unfortunately the assessments are not reviewed on a yearly basis or often at all for that matter. Typically the taxes get disputed when the market changes drastically or homes sell. This home may qualify for a tax grievance but only the assessors office can tell you. Tax grievnace day is typically the third Tuesday in June and you will get a response in the fall. They review the dispute and decide whether it qualifies for a reduction. The seller can start the process if the home is selling and if not complete before it transfers the buyer can take over. You can start by finding out the assessed value and camparing it to the list price. Call the assessors office or better yet visit them to get this info. Hope this helps!

Any agent can do a search though the Empire Access MLS that services the area and specify in a search that dogs (pets) are allowed. Many homeowners allow only a certain size dog and will limit it by weight. When you have more then one it can be more of an issue, but sometimes can be resolved by providing an additional security deposit. Carpets can be affected by dogs, especially if the next tenant has allergies. Hardwood floors can also get scratched by a large active dog. Keep in mind that commissions are negotiated by the seller with his/her agent--if you are purchasing a property with dual agency, the listing agent keeps the entire commission--it is illegal in NYS to give commission kickbacks or any kickbacks for that matter. If you are uncomfortable with the listing agent representing you as well, do ask the broker owner of the realty company to assign you an agent from within--depending how far in the process you are, it may be too late to use the services from an outside agent. You can negotiate the price however you like, and no guarantees the seller will accept nor any guarantees that the agent will accept a lesser commission. ... more

Hi, once the transaction closes you can take the HUD-1 closing statement to the town and apply for a grievance. Grievance day county-wide is the third Tuesday in the month of June. You will get the application, fill it out, attach any necessary documentation proving over assessment and then submit the application. The town will review the application and let you know sometime n the fall if you will get the grievance.

You don't need an attorney but can use one if you like. You can also hire a private tax assessor. I have the names of a few if you decide that is the route you want to go.

Basically the HUD-1 is the smoking gun and will clearly show that the home sold for much less then the assessed value. Feel free to scroll through my past blog posts I posted a detailed guide to grieving your taxes.

Generally, in the New York metropolitan area, it is customary to give a deposit equal to 10% of the purchase price. Because that now amounts to a large amount of money in our area, it is not unusual for attorney to request a 5% down payment on contract, as this money is held in a non interest bearing escrow account, and is an amount that a person would never want to walk away from. The buyer will need to have this money available when they sign the contract. Your tax would stay the same each year county does adjust taxes either up or down. If the person is over certain age per county usually 65 tax are reduced, upon sale of property would increase due to new buyer age.

That's why it's so important to work with a local expert in the towns you considering and to have your agent represent you as a buyer's agent. If they are a full time agent and doing their homework, they would most likely know something like that and should advise you so you can make an informed decision. I only work in the areas that I know and refer my buyers to professional agents in other towns they may want to research as well. In a challenging market like this, where agents are selling less houses than they may have in past years...they may be more willing to sell a buyer in an area that they are not as familiar with.
