It depends on what your by laws say, but if a majority of the owners vote yes and/or the by laws say they can, they can. Check your HOA by laws.

If they are suing you for HOA dues that are past due, they are really just wanting to be paid current. So, yes, if you can pay what is past due (or possibly work out a payment plan with them), then you should be able to get them to discontinue legal efforts against you.

Weather is the same as Dallas. The commute to downtown could be long if your driving during rush hour.

Feel free to contact me in regards to helping you. Anytime you deal with a lender you have to have the attitude of ," you want my money well earn it." Most builders will through in free upgrades, discounts and higher end packages at awesome prices. Make them work for your hard earned cash if there wasn't money in it they would be out of business. I personally love the fit of a new estate however contact justify some of the costs associated with the overall build. NOTE: I cannot help you if you don't ask for my assitance.

The listing report states that the house has been vandalized. You would need to get the house inspected by a licenced home inscpector to be able to estimate how much Structural/Mechanical repair is needed. You will get an idea how much cosmetic work need to be done when you view the house. Your Realtor can then help you determine what market value would be after renovation. Ask for a CMA (Comparable Market Analysis) report also from your Realtor. That report will determine suggested sales price based on actual closed recent sales close to the property.
