It depends on the current owner's Mortgage. Some mortgages are not assumable which means "taking over" payments is considered default. Many mortgage companies are open to this arrangement even if the loan note has this restriction you just need to get it approved first. Be sure to have a purchase agreement executed by both parties and a "Seller Financing" addendum included to protect yourself and the seller. ... more

Not all Short Sales are the same, each transaction may have a different lending insitution which is being shorted. The short sale approval or short sale application will state the restrictions of that individual lending institution or debt servicer. Find a lender and start the process. I suspect you will have to personally guarantee the loan as you do with anythign you buy or lease in the company name (copiers, cars, etc.)
After you get the loan process in place, find a great local Realtor who can assist in fnding the right place for your needs.

One word of caution, you will likely not be able to buy a short sale in teh name of an S-Corp.

The amount assessed for Property Taxes has nothing to do with the market value of the property. No, an additional bedroom is not worth $185K - maybe $3K-$10K. The owner of the property in question should contact a Realtor to pull some comps in the area (SOLD within the last 3 months, within a 1 mile radius of the property-the closer, the better). The owner should then file with the Tax Assessor using the SOLD comps from the Realtor to see if the Assessed Amount can be changed.

At SOME point, if not by you, SOME subsequent buyer - or lender - will demand that the addition is inspected, and if it fails to pass muster, it could be ordered to be repaired, or removed - in order to close a transaction.

It's as simple as that. MY advice would be for you, to demand that the addition be inspected and "permitted". Hopefully, you haven't already closed escrow on the property - you MIGHT have difficulty going back after the person who sold you the house, or the agents involved.

You didn't mention whether you wanted to keep the property - presumably as a rental - or sell it. If your question is related to your tax position, in making it a rental property vs. your personal residence, for tax purposes, then your question should be directed to a tax specialist, not a Realtor.

If you are merely going to sell the property, there is probably NO gestation period which should affect your sale, except possibly if the loan is FHA, when it could affect your buyer, for the 3 months or so, after it has funded. Bear in mind, I'm not certain on that point - and this should not be considered an authoritative opinion.
