I am not an attorney, which is what you truly need to answer your questions for your local law. That being said-you are both on the mortgage, which makes you both 100% responsible. If noone pays, both of your credit scores are damaged. If she pays only her portion and you do not-Both of your credit scores are damaged. If you pay your portion and she does not-Both of your credit scores are damaged. Only a full, on-time payment each month will keep from any negative credit reporting.

You must contact a real estate attorney to get the situation resolved. There are ways, but you need to get local, legal advice.

This is the biggest reason why it is not good to buy a house with "a friend". I wish you the best, I know its tough.
