In my experience, not much negotiation is available. appraisers have a different mindset than sellers and brokers. They tend to give little consideration to upgrades; but give a broad brush as to poor, average, or good condition. This is why it is so easy to over improve a home in a neighborhood and find the appraiser is unsympathetic in regards to your time, money and efforts you put in. Hope that helps.

It depends if you are talking about the buyer or sellers side of the closing statement. Normally, there is the settlement fee for the title company's services, Owner Title policy and Government Filing fees, electronic filing fees and other miscellaneous things that could apply whether both parties are in the same town or if things have to be shipped to another town and involve a notary. All these previous items are usually found on the statement.

Other items could be involved depending on the situation of the sale. If the property did not have a survey, the person paying that fee is determined in the contract. If there is a resale certificate necessary for a Home Owners Association that will also be determined by the contract. if any repairs are required after the inspection, that is determined by an addendum to the contract.

So in all, paying cash does simplify things but there are still some basics that are always there. The rest is unique to each property and what is agreed upon up front.

Usually this is something we see on FHA loans, as the appraiser is asked to do a mini inspection of the property.

But I can understand that a lender would ask for the repairs even on a conventional loan because no one wants to get stuck with a loan they cannot sell.

I will be watching the answers... Since I have never had this problem arise.

To clarify, an inspection is an inspectors opinion...based on facts. According to the Texas Administrative Code, Title 22, Part 23, Chapter 535, Subchapter R, RULE §535.227-Standards of Practice: General Provisions, an inspection report is defined as being used "To provide the inspector's opinions and findings on the standard inspection report form."

That being said, some inspectors are more protective of litigation by deferring to licensed professionals on most matters and being overly cautious than others. In answer to your question, you must disclose the presence of an inspection report on the disclosure, but you are only required to disclose defects or problems. If you have fixed these as you stated, then they would not be disclosable as a current problem - because they are fixed and not problems. And you could always provide a copy of the most recent inspection to show the problems left after you fixed the original issues.

I don't know about Texas but in Minnesota the commission is completely negotiable. My advice would be to interview 3 different agents and go with the one who has the best marketing plan. Have them demonstrate to you why they are worth what they are charging. Don't forget we are all independent and you get what you pay for so really review all of your options.

Ok.. here's a great little way to see what needs to be done...

Go see all of the homes in your neighborhood that are currently for sale. Be sure to take good notes as to what they are listed for, and how they compare to your property. That right there shows you what your competition is for the same buyer.

So, you make adjustments to your home based on what you have seen that make sense, and be sure to price your home just below the home that is most like yours. What this will do for you is have all the other homes in the market help to sell yours! Works like a charm.

Just one little nugget... but I'm short on time.
