Nancy, this home does not exsist on our MLS... it is perhaps some kind of marketing gimmick. If you are looking for a home in our area then you should be talking to a realtor here, often sites such as real estate.com or zillow and even trulia have incorrect and outdated information. The most accurate info comes from the realtors in the area you are looking in. If it is, it looks like it will be back on the market as a foreclosure in the relatively near future. I met Mark Palace at the Curves Vibrant Womens Conference and decided to have Palace Properties help me find a place to rent or buy. In these situationa, banks generally "Call the shots." The listing agent is caught in the middle with about the same amount of information and power as you. Banks move at their own pace(in some cases backwards) and allow things to happen based on their schedule. They have little interest in the buyer's needs, real estate guidelines, or customer satisfaction.
If you have an executed contract, you are on the inside track to obtain the property. Be patient! It's much too early to consider legal action.

Have you thought about joing a real estate investors group? There are a few in NY and there may be a couple by you. They could provide you referrals for the type of agent you seek. Another suggestion is to go out there and meet some agents in your area. It's highly likely that there are agents that like to work with investors or know about distressed properties that aren't currently on the market. Interview the agents, see you feel comfortable with. A good agent can be your ally in your investment goals. ... more
