It is unfortunate that you are upside down on the value of your property. If you can afford your payment and do not need to move for several years, then great. We are now having a foreclosure rate averaging 850 homes a month in Brevard County. Homes are still depreciating 11/2 % a month here. If you do need to or desire to move in the next few years then you need to sell now.
You may be a candidate for a short sale as you are upside down in your mortgage. Please call me as I am a certified short sale specialist.

Sorry for your loss, that is odd about the banks they should be helping you, please try calling them again, sometimes you get a 1st level operator that doesn't understand your situation. They'll usually give the payoff amount to nearly anyone that has the account number, title companies get payoffs every day. If they still won't help you you'll need to send them the documents showing you are the executor of his estate and consult with a lawyer.
If you will be selling the property you can go to to get a idea via email of what it would list for in the market.

The average commission is 6% but it varies with the level of service offered. If you are going to pay full commission make sure you are getting full service.
