I can't say for sure that they have to pay the mortage. However, with tenants in common they have inherited your partners interest. In joint tenancy, you would have inherited the shares of your partner. I would consult with an attorney to see what rights and obligations your partner's heirs have with regard to the property based on your deed and/or the will.
I'm assuming you are referring to a duplex. I'm not sure about Lakewood in particular or the exact style home you are referring to but if you mean a duplex, they are appealing to renters. Unlike a one floor rental in a multi-family or a garden apartment, a duplex is usually 2 floors. Downstairs is the kitchen, living room, maybe dining room and the bedrooms are upstairs. It allows for a bit more privacy amongst the tenants then your standard one floor rental.
With many duplexes, the owners for each side are different. I'm not sure if you are considering buying one side of a duplex or if you are buying both sides.... more
Four Seasons in Lakewood is a gated community so only residents or guests with permission of an owner can enter the community. They also have security.I will tell you the homes and cmty are beautiful. I live in Four Seasons in Jackson which is very similar. However, to make sure you are moving to a community that you will feel safe and comfortable in I'd suggest you call the local poice dept and ask them if there are any concerns for safety before you decide.... more
Bob, Right of survivorship is given when you hold property as JOINT TENANTS. One owner CAN force the sale of the property by a legal action what called a PARTITION LAWSUIT in which the court orders the property sold. Your neighbors are foolish, don't follow their lead. Forget the fines, the real risks to you are legal with respect to liability if there is a fire after the buyers close and even worse if someone is injured or dies as a result. The fire inspection involves having working fire/smoke detectors, carbon monoxide detectors and a fire extinguisher, in or by the Kitchen. None of these are costly and they are easy to install. Check out the specific requirements in your town, then do it right.... more
I think there aren't any negatives. It is a beautiful spot. Construction has been held up do to the Kara bankruptcy in 2007 and the housing collapse in 2008-2009. From what I know Maplewood (the current homebuilder) has just started marketing it again and they say they have signed a few contracts during the last few weeks. I think there prices are great and it will sell out quickly now that they have begun marketing it again.... more
