You previously mentioned your house was for sale - don't you have an agent? This is one of the great benefits to actually having an experienced real estate person working on your behalf - they can help you find good local people to sit down and talk with, rather than soliciting financial advice online......

Realtors aren't lenders, you need to actually sit down with a lender and go over ALL your options to work out some way to make your situation work - it sounds like you need to speak with a mortgage broker, rather than a bank - a broker with many different lender programs available. ty29445, it all depends on whether the SBA loan was formally included in the Chapter 7 bankruptcy that was discharged 2 year ago. If you still have copies of your BK docs, there should be a schedule detailing the debts that were included in the bankruptcy. Likewise, there may be a schedule that details debts not included.

In any case, seek the advice of a legal professional. Whether the SBA debt was or was not included in BK may not matter if you can not clear a CAIVRS check. Supporting documentation will be key to you possibly getting approved for a VA mortgage.

If the property is no longer on the market, it's possible the people renting the property either already leased it to someone else, or they changed their mind and decided not to lease it. Perhaps your agent can speak with the manager of the listing agent, and demand the deposit back. Hope this helps.

I'm a little confused about your process. All the short sales I've been involved in work like this:
a buyer makes an offer that a seller accepts
the seller's lender then provides written agreement of that accepted offer or counters that written offer
the buyer then agrees to the seller's lender written counter or counters that counter
then the buyer either continues in the escrow with the seller's lender providing a written approval or the buyer drops out if the buyer cannot reach an accord with the seller's lender/
After the original agreed upon contract between the buyer and the seller all other negotiations are carried on by the seller's lender and the buyer.
So, how can the seller be threatening you to cancel the sale if you don't pay him a certain amount of money? Only the seller's lender can be having that negotiation with you.
It is very typical for the seller's lender to counter your agreed upon price. If you can't reach an agreement about the price when the seller's lender is countering the offer then you will be forced to quit the transaction. Remember the "short" sale means that the seller's lender is getting less than owed. They're the real sellers in any short sale.
You must have signed a short sale addendum when you wrote your offer. It describes the process very clearly.
