Check your contract. In my office our contracts have a clause that allows the seller to fire us if we are not doing our job. Contact the managing broker in your agent's office. Be sure to have specific instances of proof, such as, (e.g.) you've been on the market 3 months and your agent hasn't done 1 open house as promised. Be sure the problem isn't that (e.g.) you aren't getting any showings because you are overpriced. If you are not happy with the service and you can prove your agent is lax then the managing broker is likely to let you out of your contract. Although he/she may ask for an additional 10 days to remedy the situation first. It would be wiser for them to let an unhappy customer out of their contract rather than hold them to it and have them bad-mouth the company all over town.
