The Peninsula side of the Bay. Most of the East Bay and South Bay are using the CAR forms.

PRDS refers to the pennisula region data service forms that agents on the pennisula use. They are still in use.

Intero uses the 2007 PRDS exclusive right to sell. The wording seems illegal. The 2014 form seems OK. Is it still legal to use the 2007 form?

Amazing that we still have these fifedoms where they write their own contracts and don't take advantage of the huge staff of CAR attorneys and their up-to-date research. Some habits die hard. I think the better question would be "Are there any agents out there who still use MLS books?"!!

I prefer CAR forms, and I only use PRDS if the listing agent wants me to submit an offer on it.

Dave is correct. Major SILVAR (Silicon Valley Association of Realtors) like to use these forms, and it is interesting to see comments in the MLS periodically from agents requesting "PRDS forms please."

I like to use these forms as they are very pro-buyer, and there is less opportunity for error (look at all of the different checkboxes on the CAR contract, I see too many agents make mistakes). They also incorporate "As-Is" language into the contract very nicely.

One of the disadvantages that I have seen, though, is that the seller has the option to cancel the purchase agreement if the buyer is late on one of their contingency removals.

The nice thing about the CAR (California Association of Realtors) agreements is that the seller at least has to provide a "Notice to Perform" to the buyer before cancelling.

Of course, we highly avoid trying to get into those situations. :) Just noting some differences I have seen.

Definitely the predominant form from Sunnyvale north to just before San Francisco. There are not many differences between the PRDS form and CAR's form now. There were many years ago and there was good reason to favor the PRDS form them. From what I understand PRDS has been the leader in best form to use, which eventually got accepted statewide by CAR.
