Experience with Property Line Encroachments????

Asked by Judy Boyle, Marlborough, MA Sat Jan 31, 2009

Hi All,

I am seeking opinions, experiences, rulings on any scenario that resembles this one in Massachusetts:

I have a buyer client who is interested in a particular property that abuts land that is owned by an electric company. The shed and garage that belong to the subject property both encroach upon this electric company's property by a few feet. The current owner states that the electric company has never made this an issue but we all know that it could be. The house was built in 1983, but the age of the garage and shed is least as new as the house (no older).

I know there is no way for any of us to predict what could happen, but I just wanted to pick a few brains here!

Thanks so much for your time!

Judy, recommend that your clients buy the personal title policy at closing in case the electric company ever decides to sue. I've had a similar issue in the past and that seemed to be the best remedy.
