Seller has requested additional offers even though an offer was accepted on a house in probate. Legal?

Asked by Mary Ann, Sudbury, MA Fri Feb 15, 2008

I am a broker working for a family member (do not belong to an office). I looked at a house and when I wanted to go back a second time, the broker told me an offer was made. (The house is in probate.) The MLS listing now says "accepting additional offers per request of seller" (extended about a month). Also it states that an offer has already been accepted. I have been calling the listing broker, but he has not called me back after 3 calls in a week's time. The person I am representing would like to place an offer, and I am finding this a difficult situation because the broker will not call back. Any advice? Thank you.

Does the sale require court confirmation? If so, that is why they are still asking for offers.

I always think the first offer on a probate sale has a disadvantage. I would just go ahead and submit the offer for my clients.

Don't you hate it when you don't get a return call from another agent/broker?
