If my florida home is being rented and I dont own another home can I still use my homestead exemption?

If not how do I go about correcting the problem since it has been rented starting June 08?

RJ - if you are now renting the property, you are no longer qualified to claim the Homestead exemption regardless of what other properties you own. You are also required to notify the property appraiser's office. If you are in Broward, go to http://www.bcpa.net, if it's in Miami-Dade go to http://www.miamidade.gov/propertytax. I'd be happy to direct you to any other county's site if it's neither of those.

I have cut and pasted the Florida Statute referring to this situation for you: "196.061 Rental of homestead to constitute abandonment.--The rental of an entire dwelling previously claimed to be a homestead for tax purposes shall constitute the abandonment of said dwelling as a homestead, and said abandonment shall continue until such dwelling is physically occupied by the owner thereof. However, such abandonment of such homestead after January 1 of any year shall not affect the homestead exemption for tax purposes for that particular year so long as this provision is not used for 2 consecutive years. The provisions of this section shall not apply to a member of the Armed Forces of the United States whose service in such forces is the result of a mandatory obligation imposed by the federal Selective Service Act or who volunteers for service as a member of the Armed Forces of the United States."

Check homestead exemption reason why in most states if you moved from property for # of reasons with intent move back EXAMPLE: medical issues, you might still have homestead exemption. Texas has interesting guidelines regards to these concerns. HOWEVER if income property need to report accurately.

The property as you describe is considered an income property and is not eligible for Homestead exemption.

If your home is in Broward, please see http://www.bcpa.net for further information. If not in Broward run a ggogle search for the name of your county Property Appraiser.

Homestead exemption is for your PRIMARY residence only. If this Florida home is not your primary residence, then you do not qualify to file for homestead exemption. Each year a card is mailed to that home and if it returned then the county may remove your exemption. You should call your county (Broward) or visit their web site for more information.
