Once the auction is completed it will be up to the "then" owner of the property to pursue eviction - according to Arizona law assuming the zip code provided is correct and you are in Yuma. You will receive notices from the new owner (demand for possession) and your refusal to leave the premises (if you refuse) will cause court complaint and notice of eviction. Worse coming to worse will be the constable or sheriff at your door. On the other hand, the new owner could want you to stay a while and may offer a lease or month-to-month tenancy. With so many variables there is no specific timeline, but please don't let things get out of hand and become ugly. And of course as will all legal matters, don't hesitate to contact an attorney for advice.

Also, since I don't know if your question is one of a far-gone conclusion or a consideration for making another decision...why haven't your pursued a short sale?? Contact your mortgage company and a local agent to explore this possibility.

You can also do some reading as well as find participating lenders at: https://www.harp.gov/

While this website seems legit, don't complete any forms online just in case. I don't see any, so again "just in case." Get the info and move forward from there.

"Auction the house" is not quite right as spoken by the the title company, but there has to be a Trustees Sale which is similar to an an auction. In Arizona a Trustees sale is "our way" of proceeding with a foreclosure, and since your father transferred title - it is the only way to recover the property.

As with all things, there is a proper procedure and notices must be filed...yada, yada, yada. Since it doesn't sound like you are at all familiar with the process, you should have an attorney handle it for you.
