I never dangle the prospect of being approved for a home loan by paying off old collections or charge offs unless it a part of overall strategy of raising someone's scores. The AUS (automated underwriting system) will tell us if it's necessary that you payoff those debts. Since most states have their own statute of limitations (3-4 years), it is not necessary to payoff old collections and especially charge offs if they are past the time frame of a debt being collectable. That is the whole point. We are stuck and have no recourse. Why aren't buyers protected from this kind of thing? We didn't learn of the cracked flue until we just had the chimney cleaned, three months after the sale. There is no way for us to verify the condition of a chimney flue prior to close?? This has nothing to do with the home inspection. It was a separate contractor who was asked to check out the chimney flue. ... more
