The townhall keeps records of all properties, I would check those records as a primary check point.

However, the townhall is not 100% accurate, so it very well may be that there is a mistake in the records. Your survey is a good way to back up the claim and have it changed.

Are you working with a real estate agent? It's something to consider when making such a large purchase, especially when you are talking to the owner. Remember that the owner';s interests are not the same as yours -- he is likely most interested in getting the highest possible price in the least amount of time. Your interests are obviously quite different. This is why Connecticut's Department of Consumer Protection enacted its Buyer Agency Law. You have the right to be represented by a Buyer Agent, who is allegiant to your intrests and your interests only and has no allegiance to the seller. Because the seller is paying the commission, you do not have to pay a fee for buyer representation. Even with a for-sale-by-owner, which the property you are discussing may be, the fee can be covered.

Tejas - This home is not on the market. There is a lis pendens filed on the property, which simply means that the owners are delinquent in their mortgage, so their lender has filed this initial paperwork.

This does not mean the house will be for sale or that it will be a foreclosure property, as the owners will probably try to work things out with their bank. However, it could become a foreclosure property.

The amount of $390,000 that is listed is NOT a sale price, is NOT market value, and is NOT what it will sell for. Rather, this amount is the dollar amount of the loan that has the delinquency.
