Applied for and never received a loan modification. Making the payments than the mortgage company would not accept anymore payment. The mortgage was not behind. Consulted an attorney who spoke with a rep from the mortgage company who stated we never made or was late on the mortgage. Was able to prove we were not. The mortgage company went silent. We were under the belief that we were being represented by an attorney( which we did sign a contract with) about a month or so later a realtor knocks at the door who was surprised that we were still in the house since he was told the property was vacant. Was told our home had been floreclosed. We never received any notication from the mortgage company or the attorney we hired. Please tell me how is this even legal??? ... more

That's a question for a lawyer Grace. Realtors and lenders aren't really qualified to answer that one. Any feedback you get on here should be considered hypothetical and does not represent actual legal advice

However, it would seem to me that the mortgage is a lien placed against the property and not the owner(s) so regardless of who is on the mortgage or deed, the bank can pursue a foreclosure if the payments aren't made.

I take it the reason both of you are still on the deed is to protect some equity/financial interest you have in the property, pending a payoff from your ex. That is a normal arrangement.

If your ex is not making the payments as promised and the home is headed to foreclosure, it might be in your best interest to go back to the court to see what they will do. Even if they awarded the home to him pending an equity payoff to you, they could force the sale of the home if they feel he's letting the home be foreclosed to spite you.

But again, this is something you should discuss with an attorney who can advise you on a course of action.

Most likely the HOA doesn't want to foreclose on you, but they probably can (depending on the by laws of your HOA and the deed restrictions). What they really want (most likely) is you to pay your dues so they can manage the association. Soooo, their best tool to get you to do that is the threat of a lien and foreclosure. I would not mess with them. Pay your dues as soon as you can because however painful that may be, it's probably less painful than the alternative. Best of luck... ... more

We just moved in to Marina Grande and we love it. You could not find a better view any where. Of course you have to deal with the not so pleasant issues that come with living in a condo, but that unfortunately seems to be the same in every condo. The people on the whole are very nice and they plan several events throughout the year that have been fun.
It feels as if we are in heaven every time we walk through the door. The association dues may sound high at first glance, but you get a great deal of amenities for the fee, more than I have heard of anywhere. So far we love it here. The only downside so far is meeting a person who appears to be psychologically unstable and we will have to see her at every event and when we enjoy the beautiful pool, but I wouldn't give this up for anything.
