There are down payment assistance programs, but it is best to have the money for minimum down payment and closing costs. There are also seller's credits, which your real estate agent can try to negotiate for you and a lender's credit, which may cover a few fees. How are you doing?

You are probably looking for a Home Sale Contingency. It is very common.

First and foremost, have you been "qualified" for a mortgage on the new home without having to sell your present home? If not, then you would have to sell your present home to buy the new home.

This is where the Home Sale Contingency would come into play. If properly written, you would have a certain amount of days to market and sell your property, and still be able to buy your new home.

However, this assumes that the seller will accept your offer, as compared to another one that does not contain this element in the contract. It all depends on what else you are competing with. Also, the seller may be able to "kick-out" your contract, if another comes along without that contingency.

In addition, you need to be very motivated to sell your present home, because the seller on your new home is not going to give you a lot of time.

I don't know how you found out how much the other offer was for, but if her boyfriend is really ready to buy the house, either you go higher, or he buys the house - the ex-husband should sign whichever offer nets them the most money. If that is from the new boyfriend, so be it.
The "first offer" has no rights to it. The first accepted offer does - that means accepted by all parties that need to sign. Until there is an agreement (by all), there is no agreement at all.
