Suspicion is one thing, proof is another. If you intend to pursue this, you're going to need an attorney who will review your offer, what proof you have and where you might be damaged.
A seller can choose whatever offer they want provided they don't discriminate on the basis of a protected class. If you are a member of a protected group, you may have a case, if not you may be out of luck.
If the seller has a valid business reason to accept another offer, you may be out of luck. The highest price offer doesn't always win. Sometimes a buyer waives contingencies that you may not have, or has a larger down payment, more secure loan pre-approval letter.

Hi Jan,

In our MLS, we must label properties that are under contract as "Backups Requested" under a category called "Add. Status." Trulia doesn't pick up that category. The information about listings is an automatic feed from the MLS to Trulia. Brokers can edit on Trulia (we can't on most websites), but Trulia only gives us the following categories to select from: For Sale, Sold, Pending, Active Contingency, Off Market. We would not select Pending until a property is has already gone through the buyer's due diligence period and is ready to go to closing. So the only way to solve this is to ask Trulia to provide a new category of Backups Requested. Hope this explanation helps. Feel free to call or email if you have further questions!
