You may have answered your question. By declining to be your agent, the Realtor was either a dual agent or a seller's agent which changes their primary responsibility. The Realtor's fiduciary and ethical responsibility was either to you both equally or to the seller only. The Realtor's Code of Ethics and state license laws address this very specifically. The search engine linked from the Madison Real Estate blog in is fairly decent, although Anna's right in that an agent would have more up to date info. There's a lot more pending foreclosures out there that aren't actively listed though, you can use the search feature in Trulia to give you a rough idea of what's coming up. Also sometimes the listing won't come right out and say it, if you suspect a property of being a foreclosure or short sale, use the Dane County Assessor and Circuit Court Access websites respectively to look up the property owners and see if they have a pending/completed foreclosure case.
