They just did the same thing to us. After them knowing for over a month and a half that we were interested in the house, they told us to get an inspection and pay the earnest money. So, we did. We were preapproved by them and filled out everything out with both the realtor and the Quicken Loans. Today, we get a call that it would take an additional 45 days to fill out the paperwork. They completely cancelled out our loan, because THEY could not finish the paperwork before our closing date (over a month from now).

So, now we are out the 375 for the inspection that THEY told us we needed to do and the 400 earnest money that THEY told we had to pay to go forwards. Awesome.

The woman on the phone even said "time to find a different house! teehee". That's not funny. We were doing ALL of the work ourselves, and this is what you do? You cancel the loan without even talking to us first? Because, YOU cannot finish paperwork in less than 3.5 months? Are you kidding me?

Since you had the bankruptcy in 2012 I'm assuming you are doing an FHA loan? Conventional loans require a 4 year wait after the discharge.

It sounds like someone is confusing conventional guidelines with FHA. On a conventional loan, if you have a bankruptcy with a foreclosure INCLUDED in the bankruptcy, then you can go off the shorter waiting period that the BK allows for. They make no distinction though with regards to a short sale. that is a 4 year wait.

The FHA rule for short sales however is a 3 year waiting period after the closing date of the short sale. There is no reference in FHA guidelines as to whether or not the mortgage was discharged in the bankruptcy.

So in this case, I think you probably got some bad advice early on as to what was allowed and what wasn't, either by the Realtor who talked you into doing a short sale or by the lender who said they could do the loan
