I've done a lot of dual agency situations. When I worked for a builder, as soon as unescorted buyers came in I was immediately in a dual agency position. I ALWAYS explained agency to the buyers and maybe only twice did the buyers get another agent to represent them. I never have a bad experience with dual agency but have heard some of the horror stories. To answer your question though, there should be no extra cost. I'm amazed at all of the answers that seem incorrect to me. Utah State Law requires that EM deposits are to be deposited within 3 days. While the Utah State Approved REPC may have the Seller and Buyer agree to another number of days, the State Requires 3 days for the deposit unless otherwise agreed upon by the Seller and Buyer.

There are countless different Purchase Contracts that are used in the State of Utah. For example, almost every homebuilder has their own contract that they use. These different contracts may specify all sorts of different time frames for the depositing of Earnest Money.

So in short, Earnest Money is to be deposited within 3 days unless agreed upon differently by the Buyer and Seller.

The best would be get a second bid on the townhome if you are having one built. You can also go to other builders who are building townhomes and see what their cost breakdown might be. Most builders should do a cost breakdown so everything is black and white upfront -- no surprises at the end. While there are some assistance programs for first time home buyers, there really isn't a specific loan program. You will get either a conventional or government loan. If you're looking for something with no downpayment, it would have to be either a VA loan, or and FHA loan through Utah Housing Corp (which is a downpayment assistance program). With 3.5% down you can get an FHA loan, and with 5% down you can get a Conventional. USDA rural loans are also no downpayment loans, but Salt Lake will not be eligible - you will need to look for a property in an eligible rural area.

I am assuming you have an up and down duplex in the area. I have a home I rent in the area which is 3 bedrooms and l bathroom. I receive $1099 for this home, single level. For a duplex you are probably looking around $950.00 per side because of the location. The best time to rent in the area is mid summer because all the students are looking for places to rent. I know there is a need for both HOA's and Property Management companies. I know by law, there needs to be a reserve held. What I don't understand are high HOA's for a community that doesn't have a pool or clubhouse. I believe home or condo owners that live in an HOA property managed community should get involved to find out how they can minimize this expense. A high HOA can impede the sale of a house.

Simon's sage advice, to have a home inspection is sound advice. Combine that with the seller disclosures and your legwork as part of buyer due diligence, and you should be able to have the necessary "discovery" for the answers to your question.

An experienced Realtor will know how best to utilize real estate forms/documents to gather information, protect you as you consider a purchase, protect your earnest money, and continue moving towards the best decision for you.
