How many days are you into your contract and have you signed off on your contingency yet. There are several steps to the escrow period. As long as you are still in the 17 day contingency period you are good although it is posible if the seller is a bank it was reduced to 10 days. If the house has an HOA have you gotten a copy of the CC&R's yet at which time you can also back out and keep your deposit maybe minus some charges. ... more

Delig, sounds like you'll want to speak to an attorney. Talk to your agent about the listing sheet as "subject to seller finding suitable housing" should be disclosed as well. This is also something that should have been on the P&S with a cap date. ... more

Here's another thought as well - your lender has had ample opportunity to approve you loan at this point, so why is it not approved? I would consider double-applying. At the very least, you need to find out the underwriters concerns about the house, and what is holding up approval. You loan specialist should be able to give you some details, and if they can't I'd find another underwriter. I'd like to see some of the mortgage fellows voice in, but you can't wait around indefinitely for a commitment letter. You need to find the obstacles and figure out if the risk(s) are too great for that lender.

Hi Karla- I'm a local lender, and yes- you're parents could do that under the proper circumstances. If it is a single family and they are not living there, they would have to get into it as either a second home or an investment property. Yes, if your contract has expired, the P&S should give you a closing date. If the closing didn't happen, then you no longer have a contract.. UNLESS.. you signed an extension to close that you may or may not remember?
If you don't want to buy the home and you are "out of contract", your agent should have you and your seller sign a deposit release. You should also consult an attorney if your earnest money isn't returned.
