For future reference this can be a very good way to acquire multiple investment properties without having to get a mortgage in your own name. When I acquired property for Cedar Ridge Properties, I frequently made similar purchases.

It is very important to do your research before the sale and contact various parties ahead of time. Many times you can negotiate discounts with lienholders if you offer them a lump sum settlement. This might even be possible with the mortgage if it is held by a small local bank. If it is a large institutional lender, you would be lucky if you could just get them to reduce some of the fees. I have done it in the past.

As far as a quiet title, I find it highly unlikely the bank would fail to show up. I would also consult an attorney with that question.
