The 60-day notice and the request to enter your apartment for measurements are unrelated. My understanding of the law is that for a tenant who stayed on the property notice to vacate shall be delivered 60 days prior to the vacancy date. It would be 30 days if the tenant was living on the property for less than a year.

The notification about the measurements should have been delivered to you 24 hours prior to the time of entry. The landlord only have to notify you about the visit, they don't have to get your permission to enter the premises. The same process applies to landlord, or landlord's employee, entering your unit during the whole duration of the lease.

As others said - check with a lawyer if the landlord did everything correctly.

In 94087 zip they can be rented out in minutes. If you try a few with no response try to apply the rest.

In fact many of the larger apartment complexes will only offer a 1 year lease when they could have offered a 6 month lease. These large apartment communities make money on people breaking their contract. If you are looking for a 3 month lease you are going to have to go the month-to-month route. You might be able to get a month-to-month in the Sunnyvale area but they will likely charge you slightly more per month. ... more

I won't discourage you and talk about your budget. Smart people are good with finances and having a budget shows your on right track. You,re also on the right platform to ask professional like us any question relevant to real estate. I think your focus should be on a studio in the areas you have mentioned. Thanks for the post. As others pointed out, you can try AirBnB for a possible place for your family members, but you can also just look up local area Bed and Breakfast Inns in San Jose and Santa Clara. Many of the older Victorian homes have been converted into affordable daily rentals. The most affordable ones run about $70-100 per night.

As for a short term rental, look to "corporate housing" for a rental for one month. These units are usually furnished and can be available for short periods of time--as short as 30 days. Oakwood Apartments located in Sunnyvale, San Jose, and Santa Clara all have short term, furnished units. Do keep in mind, however, that these units can be almost as expensive as a hotel and they offer cleaning and maid services at the Oakwood too. For more extended housing, try Extended Stay America's site for other options.

And, of course, if all else fails, my pals love Marriott's Residence Inn for a clean place that accommodates visits from a few days to a month.

Generally a lease agreement would make every tenant liable for the whole amount owed. If your room mate caused damage then disappeared, or simply didn't fulfill the lease, you could be forced to pay. So yes it is a problem for you.

The owner is concerned that one tenant wouldn't be able to pay the complete payment but may not move out when the rent isn't paid in full. Even if he can expect to be able to legally go after any or all of you to pay he can decide if he wishes to deal with it. Getting money from someone who doesn't have money is hard.

Lenders often have a similar criteria. If either a husband or wife has a terrible credit score while the other has an excellent score, the loan may be more likely approved if only the borrower with the excellent score applies for the loan.

Thanks for your post. The California Health and Safety Codes (HSC 1597.30-1597.621) specifically calls out the need for "neighborhood based" child care centers, and prevents homeowners associations and others from preventing someone from running a daycare or child care business in the home. As a result, any qualifying child care business is usually approved by the City to be run from a home.

However, a landlord can and often does prevent the tenants of their homes from running businesses out of the property that would involve customers or clients coming to the home daily (for traffic concerns) or the delivery of large amounts of packages (inventory). So while the City would most assuredly allow you to run the business in the rental home, most landlords would certainly not permit the business in the home, as Juliana pointed out below.

That's not to say that you won't find a landlord who will allow you to run a business from the home, but with a low inventory of rental homes available, it's likely to be harder thing to find. If you do happen to find a landlord that might consider allowing a child care facility in the home, you'll need to be prepared to prove to the landlord that the business will not damage his home or the neighborhood. You can try the following to overcome some of the landlord's concerns:

1. Show the landlord your liability insurance policy (it should be at least $1M or higher) and the landlord should be named as co-insured on your policy. Tell the landlord that you'll give them a copy of the policy and any successor policies
2. Offer to pay a much larger security deposit to cover potential damages to the home
3. Provide specifics about the number of children on the property, the ages, and the number of cars that will be going to and from the home
4. Provide the landlord with copies of your childcare service contract and offer to provide specific wording within the contract that holds the landlord harmless and blameless for any acts on the property (this would be IN ADDITION to the liability policy naming the landlord as co-insured--not instead of...)

Be prepared to provide proof that you are a responsible business owner--business license, certifications, first aid, etc.

Good luck in your hunt for a rental property! It will be harder to find a landlord who will agree to these terms, but it won't be impossible.

I just want to say one thing about craigslist, be careful, some of the homes that are on the list are fake and some home owners are rude, it is pretty frustrating contacting a home owner, they never respond to the ads, I do not know who owns craigslist..when you place a ad for anything, they do not post, like if you are selling a car or looking for something on craigslist, your post do not post, it is only if you pay for the ad, does the ad be seen, I do not mine because I post in other paid sites, but I will not on craigslist, it is like if they feel like you or your ad does not fit there style they will not post, bias issues I have found with craigslist sorry for the news but i would not count on craigslist ... more

Buying could be a good option. If you look at how quickly the equity builds up with current low interest rates it is very worth considering: $500k loan at 3% -> $55,468 equity in 5 years with a mortgage payment of $2108 plus taxes etc.
