Yes it's legal. This is what happens when you don't have a lease. First of all, you should have asked your old landlord about the deposit before the home was sold. It's too late now unless you have a contact for the old landlord.

Another issue is I'm confused by your statements: Your title states "We were month to month and landlord sold the house." Then your last sentence reads "We have a signed lease and receipt from the old landlord." Which is it? Were you month to month OR did you have a lease?
