Once you close on the property the encroachment issues become your problem and expense to cure. The time to speak with an attorney about the potential issues and ramifications is now, before you close. Your agent cannot give you the kind of legal advice you need at this point in time.

Most states have laws regarding what is called adverse possession. If the neighbors sheds on this property have been there for a specific period of time (often 7 years) and meet the other criteria about hostile and open possession, the neighbors may actually be able to claim the land their sheds sit on as their own. As I said, talk to an attorney now, before you close so you know exactly what you are dealing with. Your husband is wrong, this has the potential to be a big issue.

You could just continue until the lease expires in November and not renew it with the current tenant (since the month-to-month is an option at your discretion). Your best venue however is to contact a real estate attorney and get their advice. Unless a respondent on Trulia is also a licensed attorney, we are unable to render any type of legal advice.

as an individual, for sale by owner, you cannot on Trulia, here only Realtors, who have a listing and
it is posted on their multiple listing service are able and allowed to post their listings with photos here on the trulia site. As a for sale by owner you will have to find for sale by owner sites....

But then why are you selling on your own and not with the expertise and advertising and marketing powers of a local Realtor.... There are many reasons why you should.... and after trying to sell
on your own, you may still decide down the road to list with an experienced local Realtor.......

Mowbry Mountain is located NW of Soddy-Daisy, TN approximately 15 miles north of Chattanooga. The mountain itself begins where Waldens Ridge ends and several counties in TN all come together, Hamilton, Sequatchie, Marion, maybe Meigs. Not quite remote, it is very rural and thus you find retirees that buy here.

We do have a map search on our website, that allows you to define geography and then see all active listings on Mowbry Mountain. Let me know if you need any further info or if I may help.
