You have legal recourse against the landlord but make sure you follow the laws if your state. There are now bed Bug lawyers they actually practice that type of law. In my state their are notification requirements by the tenant and landlord responsibilities. Make sure if you do move don't go until you take care of all your personal items because you can easily transport them to your next home. Be very thorough and get a professional pest control company . If they treat don't use heat treatment because re-infestation rates are very high with heat only. If at all possible moving is not a bad idea but be careful not to take them with you. ... more

Cupertino and Sunnyvale have legiitimate BELOW MARKET RENTAL LISTINGS. Each city by law must have a BMR program, REF: State Law. Sections65580 to 65589.89

Santa Clara has an "affordable rentals" list but does not tell you which ones are BMR's.
*San Jose uses the Santa Clara County Housing search which does not distinguish the BMR'S from the Affordable's BIG DIFFERENCE.

*I called San Jose City Hall Housing Dept and they referred me to the Santa Clara County Search.
They gave me the impression that they were not aware of the BMR State Mandated Programs.

After doing some more digging on the City of San Jose website I found a section regarding this law called Housing Element, but does not provide a BMR RENTAL LISTING. Going to call to get more info.

For the record, Section Eight has not been funded since around 2005, and they have a very long waiting list, so don't waste your time with them.

I would suggest that you pick up the phone and contact a local realtor to assist you in finding a property. Some landlords accept tenants with lower credit but may ask for double deposit.

Many homes for sale there are scammers (mostly from overseas) wanting you to wire deposit etc. They use canned statements.
