Leilani, I just checked realist and did not see a NOD (Notice of Default ) filled on it. It doesn’t mean that the home owner is making payments it just simply not at the defaulted state. Have you asked the landlord if they're having issue with payments. If you would like a copy of the report feel free to email me.

i ask because the lender's loss mitigation team could be weighing as an option that you pay those costs over time, wrapping the amount up in your new payments going forward. but they're the ones who'll be instructing the trustee to file a notice of sale on your property so that's who you should be asking - the lender's loss mitigation (or your agent provider).

from what i understand, though, if your modification is accepted then they want some sort of lump sum payment for starters. check it out with your modifier before you write the check.

I'm not a CPA or an attorney so don't quote me on this. But I think if it is your primary residence and the $450k was a "purchase money" loan, you will not be 1099'd for the debt relief.

But if you did a cash out refinance and the $450k is higher than the original purchase money loan you will be 1099's for the difference. And if it is an investment property you will be 1099'd for the debt relief.

I recommend that you drive by the neighborhood in the afternoon and/or weekend. This way you get a good idea of the neighborhood. Please let me know if you have any other questions.
