New roommate: Add to the lease or not?

Asked by JonathanSenker, New York, NY Mon Jun 11, 2012

Any thoughts on advantages and disadvantages of adding a new roommate to the lease or having him as a subtenant? I know the rent is owed "jointly and severally" by two roommates on the lease. Has anyone ever seen a sublease agreement used for this? Thanks!

Depends on what is allowed by your existing lease, you do not want to be evicted for breaching your lease, good luck,

The obvious advantage to having him on the lease would be that should he decide not to meet his monthly obligation, it would impact his credit as well not just the original roommate. The disadvantage would be that if there were ever any disagreements between the two, the roommate which was added would not have to leave and could make the original roommates life hell.

best of luck and if you ever have any Queens or Western Nassau referrals let me know as we pay out 30% for all seller referrals.

Will the landlord allow such a scenario...

Which scenario? It would be substituting a new person for the roommate who is leaving (who is on the lease). Thanks.

The agreement is between the current tenant and the landlord. Unless your lease expressly states otherwise, you have to amend your lease or come to a new agreement to add another party to the lease.

If the new roommate is joining the existing roommates, I would most definitely add that person to the lease; they are equally responsible.
