Laws in every state are different and you can go online to (or call) your Sherrifs office to find out the terms of eviction in your state and county.

Where I live, if someone does not pay their rent, you have to post a 3 day notice to pay, then you go to court and if they have still not paid, they are served a 5 day eviction notice. So some of this depends upon what happened to initiate the notice. If you are following the terms of your agreement, then I would call the Sherrifs office today to see if there was an error.

Good luck!
